University of Auckland Site Act 1919

An Act to transfer certain Land in the City of Auckland to the Council of the University of Auckland as a Site for a University, and to confer certain Powers upon the said Council.

  • The words “University of Auckland” and “University” were substituted, as from 16 October 1957, for the words “Auckland University College” and “College” pursuant to section 4 University of Auckland Amendment Act 1957 (1957 No 25).

  • The words “Council of the University of Auckland” were substituted, as from 16 October 1957, for the words “Auckland University College Council” pursuant to section 5 University of Auckland Amendment Act 1957 (1957 No 25).

  • Preamble

    WHEREAS the land described in the Schedule hereto is part of the land set apart for the purposes of a Government House at Auckland, but is no longer required for those purposes: And whereas it is desired to transfer the said land to the governing body of the University of Auckland as a site for a university, on the terms and conditions hereinafter appearing:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

  • This Act may be cited as the University of Auckland Site Act 1919.

    The words “University of Auckland” were substituted, as from 16 October 1957, for the words “Auckland University College” pursuant to section 4 University of Auckland Amendment Act 1957 (1957 No 25).

2 Land vested in Council of the University of Auckland

  • The land described in the Schedule hereto is hereby vested in the Council of the University of Auckland in trust as a site for a University, subject to the provisions of this Act.

    The words “University of Auckland” and “University” were substituted, as from 16 October 1957, for the words “Auckland University College” and “University college” pursuant to section 4 University of Auckland Amendment Act 1957 (1957 No 25).

    The words “Council of the University of Auckland” were substituted, as from 16 October 1957, for the words “Auckland University College Council” pursuant to section 5 University of Auckland Amendment Act 1957 (1957 No 25). See section 13 Reserves and other Lands Disposal and Public Bodies Empowering Act 1925 (1925 No 46), as to exchanging part of Government House grounds at Auckland for land vested in Auckland University College Council.

3 Council to erect university buildings

  • (1) The said Council shall erect on the said land buildings suitable for a University college to the satisfaction of the Minister of Education.

    (2) No building shall be erected on the said land except according to plans and in the manner approved by the said Minister.

    (3) Unless within ten years after the passing of this Act the said Council has erected buildings as aforesaid, the Governor-General may, by Proclamation, resume possession of such land, and the land shall as from the date of that Proclamation revert to the Crown.

    The word “University” was substituted, as from 16 October 1957, for the words “University college” pursuant to section 4 University of Auckland Amendment Act 1957 (1957 No 25).

4 Council may take adjacent land for purposes of University

  • (1) The said Council is hereby empowered to take, with the consent of the Minister of Education and in accordance with the provisions of the Public Works Act 1908, any lands adjacent to the land hereby vested in the Council, and for that purpose the said Council shall be deemed to have all the powers and authorities by that Act conferred upon a local authority with respect to the taking of lands for public works.

    (2) All lands acquired by the Council under this section shall be held by it in trust for the purposes of a University.

    The word “University” was substituted, as from 16 October 1957, for the words “University college” pursuant to section 4 University of Auckland Amendment Act 1957 (1957 No 25).

Schedule

ALL that area in the Auckland Land District, containing by admeasurement 3 acres 3 roods, more or less, being Allotment 2 of Section 6, City of Auckland: commencing at the westernmost corner of Allotment 1 of Section 6, City of Auckland: bounded towards the north-east by Allotment 1 of Section 6, City of Auckland, bearing 126° 24′ 20″, 367.75 links; 130° 34′ 56″, 104.47 links; and 148° 16′ 18″, 621.27 links: towards the south-east by Symonds Street, bearing 224° 28′ 57″, 249.69 links: towards the south-west by Allotment 3 of Section 6 aforesaid, 307° 28′, 572.30 links; and Subdivisions 1 and 2 of Lot 2 of Allotment 3 of Section 13, City of Auckland, bearing 329°, 197 links; 249° 1′, 24 links; and 334° 53′, 168.54 links: and towards the north-west by Princes Street, bearing 20° 16′ 48″, 353.70 links, to the point of commencement: be all the aforesaid bearings and linkages more or less: as the same is delineated on the plan marked L 57254, deposited in the Head Office, Department of Lands, at Wellington, and thereon edged red.
