An Act to amend the River Boards Act 1908

1 Short Title
  • This Act may be cited as the River Boards Amendment Act 1952, and shall be read together with and deemed part of the River Boards Act 1908 (hereinafter referred to as the principal Act).

    (3) All references to the Clerk of a River Board in the principal Act, or in any other Act, or in any regulation, Order in Council, or bylaw, or in any contract, agreement, deed, instrument, application, notice, or other document shall be read hereafter as references to the Secretary of a River Board.

5 Board may prohibit or regulate planting of trees along river banks
  • (1) The Board may from time to time, by special order,—

    • (a) Prohibit or regulate the planting of any trees, hedges, or other plants or the erection of any structures on or within a specified distance from the banks of any river, stream, watercourse, or drain within the jurisdiction of the Board where they will obstruct or are likely to obstruct the free passage along the banks of the river, stream, watercourse, or drain of machinery or apparatus used for the purposes of cleaning the river, stream, watercourse, or drain:

    • (b) Require owners and occupiers of land on which any trees, hedges, or other plants are planted or structures are erected in breach of the special order to remove the same.

    (2) Every person who commits a breach of any such special order commits an offence, and shall be liable on conviction to a fine not exceeding $20.
