10 Application of Act to island territories
  • (1) This Act shall be in force in the Cook Islands, and Tokelau.

    (2) In this Act, except in this section, both in New Zealand and in the Cook Islands, and Tokelau, the term New Zealand shall be construed as including the Cook Islands, and Tokelau.

    (3) Every reference in this Act to the Attorney-General shall be construed,—

    • (a) In the application of this Act to the Cook Islands, other than Niue, as including the High Commissioner of the Cook Islands:

    • (b) In the application of this Act to the Island of Niue, as including the Cabinet of Ministers of Niue:

    • (c) In the application of this Act to Tokelau, as including the Administrator of Tokelau.

    • (d) [Repealed]

    (4) The other Ministers specified in this Act may exercise the powers conferred on them by this Act in the Cook Islands, and Tokelau.

    (5) All criminal jurisdiction conferred by this Act may be exercised by the High Court of the Cook Islands in the ordinary course of its criminal jurisdiction. For the purposes of this subsection, subsection (1) of section 3 of this Act shall apply as if the word indictable were omitted.

    (6) [Repealed]

    The word Tokelau was substituted for the words Tokelau Islands, as from 9 December 1976, pursuant to section 3(8) Tokelau Amendment Act 1976 (1976 No 122).

    Subsections (1) and (2) were amended, as from 24 November 1961, by section 9 Western Samoa Act 1961 by substituting the words and Tokelau for the words Tokelau and Western Samoa

    In subsection (3)(a) the words the High Commissioner of the Cook Islands were substituted for the words Resident Commissioner of Rarotonga, as from 4 August 1965, pursuant to section 57(3) Cook Islands Amendment Act 1964 (1964 No 70).

    In subsection (3)(b) the words the Cabinet of Ministers of Niue were substituted for the words Resident Commissioner of Niue, as from 19 October 1974, pursuant to section 2(2)(c) Niue Amendment Act 1974 (1974 No 43).

    Subsection (3)(d) was repealed by section 10(1) of the Western Samoa Act 1961.

    Subsection (4) was amended, as from 1 January 1962, by section 9 Western Samoa Act 1961 (1961 No 68) by substituting the words and Tokelau for the words Tokelau and Western Samoa.

    Subsection (5) was amended, as from 1 January 1962, by section 9 Western Samoa Act 1961 (1961 No 68) by omitting the words or by the High Court of Samoa in the ordinary course of its criminal jurisdiction.

    Subsection (6) was repealed by section 10(1) of the Western Samoa Act 1961.
