(1) Any member of the Council appointed under paragraph (d) or paragraph (e) or paragraph (f) of section 5(2) of this Act may at any time be removed from office by the Minister for inability to perform the functions of the office, bankruptcy, neglect of duty, or misconduct proved to the satisfaction of the Minister.
(2) Any member of the Council appointed under paragraph (d) or paragraph (e) or paragraph (f) of section 5(2) of this Act may at any time resign the office of member of the Council by notice in writing addressed to the Minister.
(3) Every member of the Council appointed under paragraph (d) or paragraph (e) or paragraph (f) of section 5(2) of this Act who, by virtue of section 5A(2) of this Act, becomes ineligible for appointment as a member of the Council shall cease to be a member of the Council.
(4) The powers of the Council shall not be affected by any vacancy in its membership.

Subsection (1) was amended, as from 1 January 2002, by section 70(1) Human Rights Amendment Act 2001 (2001 No 96), by substituting “inability to perform the functions of the office”
for the word “disability”
