(1) There shall be a Board of Trustees of the Foundation to be called the Board of Trustees of the Pacific Islands Polynesian Education Foundation.

(3) In the absence from any meeting of any member being an officer of any Department of the Public Service he may authorise any other officer of his Department to attend that meeting in his stead. Any person who attends any meeting of the Board pursuant to this subsection shall for the purposes of that meeting be deemed to be a member of the Board.
(4) In the absence from any meeting of any member appointed under subsection (2) of this section he may, with the joint approval of the Minister and of the Minister of Pacific Island Affairs, authorise any other person to attend that meeting in his stead. Any person who attends any meeting of the Board pursuant to this subsection shall, for the purposes of that meeting, be deemed to be a member of the Board.
(5) Any person appointed to the Board by the Governor-General under subsection (2) of this section shall be appointed for a term of 3 years but shall be eligible for reappointment.
(6) Any Trustee appointed by the Governor-General may be at any time removed from office by the Governor-General for inability to adequately perform the duties of office, bankruptcy, neglect of duty, or misconduct, proved to the satisfaction of the Governor-General, or may at any time resign his office by writing addressed to the Minister.
(7) If any appointed Trustee dies, is removed from office, or resigns, the vacancy so created shall be filled in the manner in which the appointment to the vacant office was originally made. Every person so appointed shall be appointed for the residue of the term for which his predecessor was appointed.
(8) Unless he sooner vacates his office as provided in subsection (7) of this section, every appointed Trustee shall continue in office until his successor comes into office, notwithstanding that the term for which he was appointed may have expired.
(9) The powers of the Board shall not be affected by any vacancy in the membership thereof.
Subsection (2)(c) was amended, as from 1 January 1975, by section 5(3) Maori Affairs Amendment Act 1974 (1974 No 73) by substituting the reference “the Secretary for Maori Affairs”
for the reference “the Secretary for Maori and Island Affairs”

Subsections (2)(e) and (4) were amended, as from 22 October 1981, by section 2(a) and (b) respectively of the Pacific Islands Polynesian Education Foundation Amendment Act 1981 (1981 No 83) by substituting the word “Maori”
for the word “Island”
. These subsections were further amended, as from 30 March 1987, by section 2(1) Pacific Islands Polynesian Education Foundation Amendment Act 1987 (1987 No 43) by substituting the words “Pacific Island”
for the word “Maori”

Subsection (6) was amended, as from 25 October 2001, by section 81 Education Standards Act 2001 (2001 No 88) by substituting the words “inability to adequately perform the duties of office”
for the word “disability”
