8C Limitations on further applications
  • (1) Subject to subsection (2) of this section, where an application for an exemption is made under section 8B of this Act, and the exemption is refused, no further application that is the same or substantially the same as the first application may be made (whether to the same person or body or a different person or body) within the period of 6 months after the date of that refusal.

    (2) A further application may be made within the period specified in subsection (1) of this section if the Director-General or, as the case requires, the territorial authority to which the application is made is satisfied that there are special circumstances justifying the making of the further application within that period.
