An Act to amend the Social Security Act 1964

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title
  • This Act may be cited as the Social Security Amendment Act 1982 and shall be read together with and deemed part of the Social Security Act 1964 (hereinafter referred to as the principal Act).

Part 1
Monetary benefits

2 Interpretation
  • (1) [Repealed]

    (2) The following enactments are hereby consequentially repealed:

    • (d) Section 2(2) and (3) of the Social Security Amendment Act 1979:

    • (e) Section 2 of the Social Security Amendment Act 1981.

    Subsection 2(1) was impliedly repealed, as from 25 July 1990, by section 2(1) Social Security Amendment Act (No 2) 1990 (1990 No 74), and, as from 1 April 1991, by section 2(2) Social Security Amendment Act 1991 (1991 No 1).

10 Repealing provisions relating to television-licence-fee concessions
11 Disability allowance
  • (1) [Repealed]

    (2) 

    Subsection 11(1) was repealed, as from 12 December 1985, by section 15(3)(d) Social Security Amendment Act (No 2) 1985 (1985 No 159).

12 Beneficiaries in hospital
  • (1) This subsection substituted s 75 of the principal Act.

    (2) The following enactments are hereby consequentially repealed

    • (a) Section 24 of the Social Security Amendment Act 1976:

    • (b) Section 11 of the Social Security Amendment Act 1981.

    (3) If a married person with no dependent children is a patient in hospital on the date of commencement of this section, section 75 of the principal Act shall continue to apply in respect of that person, while he or she remains in hospital, as if this section had not come into force until the expiry of 13 weeks after that date.

13 Forfeiture of benefit during detention in a penal institution
  • (1) This subsection substituted section 76 of the principal Act.

    (2) The following enactments are hereby consequentially repealed:

    • (a) Section 25 of the Social Security Amendment Act 1976:

    Section 14 was repealed, as from 30 July 1988, by section 21(2)(a) Social Security Amendment Act 1988 (1988 No 138).

15 Repealing provisions relating to termination of benefit on death
  • (1) 

    (2) The following enactments are hereby consequentially repealed:

    • (a) Section 4 of the Social Security Amendment Act 1967:

    • (e) Section 29 of the Social Security Amendment Act 1976:

    (3) This section shall be deemed to have come into force on the 28th day of September 1982, and shall apply in respect of persons dying on or after that date.

    (4) The provisions of the principal Act shall continue to apply in respect of persons dying before the 28th day of September 1982 as if this section had not been enacted.

    Subsections 15(3) and (4) were inserted, as from 28 September 1982, by section 7(4) Social Security Amendment Act (No 2) 1982 (1982 No 154).
