An Act to amend the Fire Service Act 1975

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title and commencement
  • This Act may be cited as the Fire Service Amendment Act 1986, and shall be read together with and deemed part of the Fire Service Act 1975 (in this Act referred to as the principal Act).

    • (2) Subject to subsection (3) of this section, this Act shall come into force on the 1st day of July 1986.

    • (3) Section 5 of this Act shall be deemed to have come into force on the 31st day of March 1986.

    (5) The Fire Service Amendment Act 1978 is hereby consequentially amended by repealing section 2(3).

    (8) The Local Government Act 1974 is hereby amended by omitting from Schedule 17 (as inserted by section 6 of the Local Government Amendment Act 1979) the reference to the Fire Service Act 1975.

    Subsections (1) to (4) were repealed, as from 1 January 1991, by section 2(2)(c) Fire Service Amendment Act 1990 (1990 No 136).

    Subsection (7) was repealed, as from 1 January 1991, by section 29(2) Fire Service Amendment Act 1990.

3 Accounts and annual report of Commission

    (3) This subsection repealed section 46(6) of the principal Act.

    (4) The Fire Service Amendment Act 1978 is hereby consequentially amended by repealing section 16.

    Subsection (1) was repealed, as from 1 October 1988, by section 16(1) Trustee Amendment Act 1988 (1988 No 119).

8 Levy
  • (1) This subsection substituted section 48 of the principal Act.

    (2) Notwithstanding anything in this Act, where a levy was due and payable on any contract of fire insurance on or before the 30th day of June 1986, that levy shall remain due and payable, and the provisions of the principal Act, as in force before the commencement of this section, shall apply accordingly.

    (3) Notwithstanding anything in this Act, where the Minister has, pursuant to section 48 of the principal Act, as in force before the commencement of this section, by notice in the Gazette, altered the rate of the levy, and the alteration of the levy is to take effect on the 1st day of July 1986 or on any subsequent date, the provisions of that notice shall apply to section 48 of the principal Act (as substituted by subsection (1) of this section).

    (4) Section 2(1) of the Fire Service Amendment Act 1982 is hereby consequentially repealed.

12 Payment of levy
  • (1) This subsection substituted section 50 of the principal Act.

    (2) Notwithstanding anything in this Act, the provisions of the principal Act, as in force before the coming into force of this Act, shall apply with respect to the instalment of fire insurance premium income contribution payable on the 15th day of September 1986, and with respect to any instalment of fire insurance premium income contribution which is unpaid at the time of the coming into force of this Act and which was due and payable prior to the coming into force of this Act.

13 Audit of contracts of fire insurance, etc
  • (1) This subsection substituted section 51 of the principal Act.

    (2) Notwithstanding anything in this Act, the provisions of the principal Act, as in force before the commencement of this Act, shall apply with respect to any return of income which was required to be completed and sent to the Commission under section 51 of the principal Act (as in force before the commencement of this Act) prior to the coming into force of this Act, but which was not completed and sent to the Commission.

    (3) Notwithstanding anything in this Act or the principal Act, subsections (3) to (7) of section 51 of the principal Act (as in force before the commencement of this Act) shall apply with respect to the instalment of premium contribution payable on the 15th day of September 1986 and any instalment of premium contribution which is unpaid at the time of the coming into force of this Act and which was due and payable prior to the coming into force of this Act.

    (4) Section 18 of the Fire Service Amendment Act 1978 is hereby consequentially repealed.

    Section 14 was repealed, as from 1 April 1987, by section 25(2)(b) Official Information Amendment Act 1987 (1987 No 8).

15 Failure to repay levy
  • (1) This subsection substituted section 53 of the principal Act.

    (2) Notwithstanding anything in this Act, the provisions of the principal Act, as in force before the commencement of this Act shall apply with respect to the instalment of fire insurance premium contribution due and payable on the 15th day of September 1986 and to any instalment of fire insurance premium contribution which is unpaid at the time of the coming into force of this Act and which was due and payable prior to the coming into force of this Act.

    (3) Section 19 of the Fire Service Amendment Act 1978 is hereby consequentially repealed.

17 Revocations
  • The Fire Service (Levy) Regulations 1975 and the Fire Service (Levy) Regulations 1975, Amendment No 1 are hereby revoked.
