An Act to amend the Official Information Act 1982

1 Short Title and commencement
  • (1) This Act may be cited as the Official Information Amendment Act 1987, and shall be read together with and deemed part of the Official Information Act 1982 (hereinafter referred to as the principal Act).

    (2) Except as provided in section 14(2) of this Act, this Act shall come into force on the 1st day of April 1987.

7 Transfer of requests
  • (1) [Repealed]

    (2) Where a request to which section 14 of the principal Act applies had not been transferred before the commencement of this Act, that request shall, notwithstanding anything in that section, be transferred under that section within 10 working days after the date of the commencement of this Act; but section 15A of the principal Act shall apply in respect of the time limit set out in this subsection as if that time limit were set out in section 14 of the principal Act.

    Subsection (1) was repealed by section 57(2) of the Local Government Official Information and Meetings Act 1987. See section 1(2) of that Act.

8 Decisions on requests
  • (1) This subsection substituted section 15 of the principal Act.

    (2) Where section 15 of the principal Act requires that a decision be made under that section in respect of a request and that request was received before the commencement of this Act, that decision shall, notwithstanding anything in that section, be made within 20 working days after the date of the commencement of this Act; but section 15A of the principal Act shall apply in respect of the time limit set out in this subsection as if that time limit were set out in section 15(1) of the principal Act.

17 Requirements of Ombudsman to be complied with within certain period
  • (1) This subsection inserted section 29A in the principal Act.

    (2) This subsection inserted subs (1A) in section 35 of the principal Act.

    (3) Where, in relation to any investigation by an Ombudsman under section 28 or section 35 of the principal Act, a Department or Minister of the Crown or organisation is required, pursuant to section 29A(1) of the principal Act, to comply with a requirement of an Ombudsman, and that requirement was received before the commencement of this Act, that Department or Minister of the Crown or organisation shall, notwithstanding anything in this section, comply with that requirement within 20 working days after the date of the commencement of this Act; but section 29A(2) of the principal Act shall apply in respect of the time limit set out in this subsection as if that time limit were set out in section 29A(1) of the principal Act.

23 New Schedule 1 substituted
  • (1) 

    (2) The following enactments are hereby consequentially repealed, namely:

    • (a) Section 4 of the Official Information Amendment Act 1983:

    • (c) [Repealed]

    Subsection (2)(c) was repealed, as from 1 December 1988, by section 12(2) New Zealand Trade Development Board Act 1988 (1988 No 160).

  • (1)

  • This Schedule was amended, as from 1 July 1995, by section 4(1)(c) Ministry of Agriculture and Fisheries (Restructuring) Act 1995 (1995 No 31) by omitting the item relating to the Ministry of Agriculture and Fisheries Act 1953. See also subsection (2) of that section.

  • This Schedule was further amended, as from 2 July 1996, by section 7(2)(b) New Zealand Security Intelligence Service Amendment Act 1996by omitting the item relating to the New Zealand Security Intelligence Service Act 1969.

  • This Schedule was further amended, as from 1 October 1996, by section 290(1) Customs and Excise Act 1996 (1996 No 27) by omitting the item relating to the Customs Act 1966.

  • This Schedule was further amended, as from 17 December 1997, by section 54 Pork Industry Board Act 1997 (1997 No 106) by omitting the item relating to the Pork Industry Board Act 1982.

  • This Schedule was further amended, as from 2 July 2001, by section 86(1) Agricultural Compounds and Veterinary Medicines Act 1997 (1997 No 87) by omitting the item relating to the Animal Remedies Act 1967. See Part 8 (comprising sections 87 to 122) of that Act as to the transitional provisions. See clause 2 Agricultural Compounds and Veterinary Medicines Act Commencement Order 2001 (SR 2001/100).

  • This Schedule was further amended, as from 2 July 2001, by section 150(1) Hazardous Substances and New Organisms Act 1996 (1996 No 30) by omitting items relating to the Pesticides Act 1979 and the Toxic Substances Act 1979. See Parts 11 to 16 of that Act (comprising sections 151 to 259) as to the transitional provisions. See clause 2 Hazardous Substances and New Organisms Act Commencement Order (No 2) 2001 (SR 2001/171).
