An Act to amend the Social Security Act 1964

BE IT ENACTED by the Parliament of New Zealand as follows:

1 Short Title
  • This Act may be cited as the Social Security Amendment Act 1987, and shall be read together with and deemed part of the Social Security Act 1964 (hereinafter referred to as the principal Act).

Part 1
Amendments to principal Act

2 Abolition of Social Security Commission and transfer of powers to Director-General
  • (1) 

    • (a) This paragraph repealed the definition of Commission in s 3(1) of the principal Act.

    • (b) This paragraph inserted the definition of Director-General in s 3(1) of the principal Act.

    (2) This subsection substituted section 5 of the principal Act.

    (3) The principal Act is hereby amended—

    (4) Every reference to the Social Security Commission in any Act, Order in Council, Proclamation, regulations, notice, rules, agreement, deed, instrument, or document whatsoever shall hereafter be read as a reference to the chief executive of the department for the time being responsible for the administration of the Social Security Act 1964.

    (5) 

    Subsection (1)(a) was repealed, as from 1 April 1994, by section 6(c) Social Welfare (Transitional Provisions) Amendment Act (No 2) 1993 (1993 No 149).

    Subsection (1)(b) was repealed, as from 1 April 1990, by section 34(3)(b) Social Welfare (Transitional Provisions) Act 1990 (1990 No 26).

    Subsection (3)(a) was repealed, as from 1 April 1994, by section 6(c) Social Welfare (Transitional Provisions) Amendment Act (No 2) 1993 (1993 No 149).

    Subsection (4) was amended, as from 1 October 1999, by section 13 Department of Child, Youth and Family Services Act 1999 (1999 No 82) by substituting the words chief executive of the department for the time being responsible for the administration of the Social Security Act 1964 for the words Director-General of Social Welfare.

3 Delegation of Director-General's powers

    Subsection (2) was impliedly repealed, as from 23 June 1987, by section 2(2) and 3(1) Social Security Amendment Act 1987 (1987 No 106).

    This section was repealed, as from 1 October 1998, by section 12(b) Employment Services and Income Support (Integrated Administration) Act 1998 (1998 No 96).

10 Removal of exemption from liable parent scheme
  • (1) Section 2 of the Social Security Amendment Act 1980 is hereby repealed.

    (2) Notwithstanding subsection (1) of this section, if any person, immediately before the commencement of this section, was in receipt of a domestic purposes benefit to which section 2 of the Social Security Amendment Act 1980 applied, the Director-General shall continue to assess and pay the benefits as if subsection (1) of this section had not been enacted until the benefit is first renewed under section 80(4) of the principal Act.

    (3) This section shall come into force on the 1st day of October 1987.

11 Domestic purposes benefits for solo parents

    • (a) Section 5(2) of the Social Security Amendment Act 1976:

    • (c) Section 5 of the Social Security Amendment Act 1980.
