An Act to repeal the Labour Department Act 1954

BE IT ENACTED by the Parliament of New Zealand as follows:

1 Short Title
  • This Act may be cited as the Labour Department Act Repeal Act 1989.

2 Repealing Labour Department Act 1954
  • (1) The Labour Department Act 1954 is hereby repealed.

    (2) The enactments specified in the Schedule are hereby consequentially repealed.

    (3) Nothing in this section affects—

    • (a) the continued existence of the department of State existing immediately before the commencement of the Labour Department Act 1903 and known then, and immediately before the commencement of this Act, as the Department of Labour; or

    • (b) the appointment or tenure of the chief executive, or any other employee, of the Department of Labour; or

    • (c) the continued existence of any advisory council or committee appointed under section 11 of the Labour Department Act 1954.

    (4) Every delegation under section 7 or section 7A of the Labour Department Act 1954 that was in force immediately before the commencement of this Act shall continue to have effect according to its tenor as if it had been made on that commencement under section 28 or section 41 of the State Sector Act 1988.

    (5) Every reference in—

    • (a) any Act, regulation, or other enactment, passed, made, or enacted before 11 June 1985; or

    • (b) any contract, agreement, deed, instrument, application, licence, notice, or other document entered into, made, granted, given, or executed, before 1 November 1954,—

    to the Minister of Employment shall continue to be read as a reference to the Minister of Labour.

    (6) Every reference to the National Employment Service in any enactment or document shall continue to be read as a reference to the Department of Labour.

    (7) Every reference to the Director of Employment in any enactment or document shall continue to be read as a reference to the Secretary of Labour.

    (8) Every reference in—

    • (a) any Act, regulation, or other enactment, passed, made, or enacted before the commencement of this Act; or

    • (b) any contract, agreement, deed, instrument, application, licence, notice, or other document, entered into, made, granted, given, or executed, before that commencement,—

    to the Secretary of Labour appointed under the Labour Department Act 1954 shall be read as a reference to the chief executive of the Department of Labour.

    (9) The following regulations are hereby revoked:

    • (a) the Employment (Information) Regulations 1954:

    • (b) the Employment (Information) Regulations 1954, Amendment No 1.

  • Schedule Vocational Training Act 1982: repealed, on 1 July 1994, by section 21(1) of the Industry Training Act 1992 (1992 No 55).


This Act is administered by the Department of Labour.
