9 Smoking restricted in passenger service vehicles

(1)

This section applies to the following (passenger service vehicles):

(a)

a large passenger service vehicle while it is carrying passengers:

(b)

a small passenger service vehicle at all times except when it is returning from carrying a passenger at the end of a shift:

(c)

a vehicle being used in a small passenger service.

(2)

The operator of a passenger service vehicle must not permit any person to smoke in the vehicle.

(3)

No person may smoke in a passenger service vehicle.

(4)

In this section,—

large passenger service vehicle has the same meaning as in section 2(1) of the Land Transport Act 1998

small passenger service has the same meaning as in section 2(1) of the Land Transport Act 1998

small passenger service vehicle has the same meaning as in section 2(1) of the Land Transport Act 1998.
