2 Interpretation
  • In this Act, unless the context otherwise requires,—

    Agency

    [Repealed]

    Agency: this definition was amended, as from 1 August 2000, by regulation 4(1) Education (Change of Name of Education Entities) Order 2000 (SR 2000/117) by substituting the words Skill New Zealand for the words the Education and Training Support Agency.

    Agency: this definition was repealed, as from 1 January 2003, by section 4(1) Industry Training Amendment Act 2002 (2002 No 51).

    Applicant organisation

    Apprenticeship contract means a contract of apprenticeship, registered under section 13 of the Apprenticeship Act 1983, that was in force immediately before the 1st day of July 1992

    Apprenticeship contract: this definition was amended (as from 1 July 1992) by section 2 Industry Training Amendment Act 1993 (1993 No 52) by substituting the expression 13 for the expression 19.

    Board

    Board: this definition was repealed, as from 1 January 2003, by section 4(1) Industry Training Amendment Act 2002 (2002 No 51).

    Commission means the Tertiary Education Commission established by section 159C of the Education Act 1989.

    Commission: this definition was inserted, as from 1 January 2003, by section 4(2) Industry Training Amendment Act 2002 (2002 No 51).

    employment agreement has the same meaning as in the Employment Relations Act 2000

    Employment agreement: this definition was substituted for the definition of the term Employment contract, as from 2 October 2000, by section 240 Employment Relations Act 2000 (2000 No 24).

    Employment contract

    Employment contract: this definition was replaced by a definition of the term Employment agreement, as from 2 October 2000 by section 240 Employment Relations Act 2000 (2000 No 24).

    Funding agreement

    [Repealed]

    Funding agreement: this definition was amended, as from 1 January 2003, by section 20 Industry Training Amendment Act 2002 (2002 No 51) by substituting the words section 10(1), (2), or (2A) for the words subsection (1) or subsection (2) of section 10 of this Act.

    Funding agreement: this definition was repealed, as from 1 January 2004, by section 4(3)Industry Training Amendment Act 2002 (2002 No 51).

    Industry means 2 or more enterprises that use—

    • (a) Similar inputs and methods of production to produce similar products; or

    • (b) Similar methods to provide similar services;—

    and, in relation to any industry training organisation, means the industry in respect of which the organisation is for the time being recognised

    Industry training means systematic training, provided for people employed in an industry (or 2 or more industries)—

    • (a) By or on behalf of employers in the industry (or industries); or

    • (b) For the benefit of employers and employees in the industry (or industries),—

    in skills characteristic of, or likely to be valuable to, people engaged in the industry (or industries)

    Industry training organisation means a body corporate for the time being recognised under section 5 or section 8(1) of this Act

    Minister means the Minister of the Crown who, under the authority of any warrant or with the authority of the Prime Minister, is for the time being responsible for the administration of this Act

    profile means a document of the kind described in section 159W of the Education Act 1989.

    Qualifications authority means the New Zealand Qualifications Authority established by section 248(1) of the Education Act 1989

    Recognise means recognise for the purposes of this Act

    Satisfied means satisfied on reasonable grounds

    Similar includes the same, and related

    Skills includes methods and knowledge

    Skill standard,—

    • (a) Means a specification of skills, and levels of performance in those skills; and

    • (b) In relation to any industry training (or proposed industry training), means a specification of some or all of the skills in which training is (or is proposed to be) received, and the levels of performance in those skills intended to be attained by people receiving the training:

    statement of tertiary education priorities means the statement of tertiary education priorities issued by the Minister under section 159AC of the Education Act 1989.

    Technician's contract means a contract (within the meaning of section 2 of the Technicians Training Act 1967) that was in force immediately before the 1st day of July 1992

    Technicians' determination means a determination under section 4 of the Technicians Training Act 1967 (whether or not at any time amended or consolidated under that Act) that was in force immediately before the 1st day of July 1992

    Training board means an industry training board established under the Vocational Training Act 1982.
