28 Trade secrets

(1)

Subject to subsection (2), an agency may refuse to disclose any information requested pursuant to principle 6 if the withholding of the information is necessary to protect information where the making available of the information—

(a)

would disclose a trade secret; or

(b)

would be likely unreasonably to prejudice the commercial position of the person who supplied or who is the subject of the information.

(2)

Information may not be withheld under subsection (1) if, in the circumstances of the particular case, the withholding of that information is outweighed by other considerations which render it desirable, in the public interest, to make the information available.
