92 Compliance with requirements of Commissioner

(1)

This section applies in every case where, during the course of an investigation under Part 8 of any decision of any agency in relation to an information privacy request, the Commissioner, pursuant to any power conferred on the Commissioner by section 91, requires that agency to furnish or produce to the Commissioner any information or document or thing which relates to that investigation.

(2)

In any case to which this section applies, the agency to which the requirement is made shall, subject to section 93, as soon as reasonably practicable, and in no case later than 20 working days after the day on which the requirement is received by the agency, comply with the requirement.

(3)

If any agency (being a department or a Minister or an organisation) fails, within the time limit fixed by subsection (2) (or, where that time limit has been extended under section 93, within that time limit as so extended), to comply with any requirement to which subsection (1) applies, the Commissioner may report such failure to the Prime Minister.
