148 Procedure where election not contested

(1)

If—

(a)

only 1 constituency candidate is nominated in a district; or

(b)

any constituency candidate who has been nominated duly withdraws his or her nomination and there remains only 1 constituency candidate,—

the Electoral Commission must, in accordance with section 179(2), declare the constituency candidate to be duly elected.

(2)

The name of the person so elected must be endorsed on the writ by an Electoral Commissioner on behalf of the Electoral Commission, and the writ must be returned to the Clerk of the House of Representatives in accordance with section 185.
