An Act to amend The Disputes Tribunals Act 1988

BE IT ENACTED by the Parliament of New Zealand as follows:

1 Short Title and commencement
  • (1) This Act may be cited as the Disputes Tribunals Amendment Act 1998, and is part of The Disputes Tribunals Act 1988 (the principal Act).

    (2) This Act comes into force on the day after the date on which it receives the Royal assent.

2 Interpretation
  • This section inserted the definition of the term Principal Disputes Referee in s 2 of the principal Act.

3 New sections substituted
  • This section substituted s 6, and inserted ss 6A to 6C of the principal Act.

4 Appointment of Referees
  • This section amended s 7(4) of the principal Act.

5 Salary and allowances of Principal Disputes Referee
  • This section inserted s 8A of the principal Act.

6 Jurisdiction of Tribunals
  • This section amended s 10(3) of the principal Act.

7 Extension of jurisdiction by agreement between the parties
  • This section amended s 13(2) of the principal Act.

8 Orders of Tribunal
    • (a) This paragraph amended s 19(5), (6), and (7) of the principal Act.

    • (b) This paragraph amended s 19(7) of the principal Act.

9 Rules
  • This section amended s 60(2)(a) of the principal Act.

10 Consequential amendments
  • The enactments specified in the Schedule are amended in the manner indicated in that schedule.

Section 10

This Schedule amended the following provisions: s 14A Minor' Contracts Act 1969; s 9A Illegal Contracts Act 1970; s 47A Hire Purchase Act 1971; s 10 Contractual Mistakes Act 1977; Schedule 4 to the Higher Salaries Commission Act 1977; s 24A Fencing Act 1978; s 13 Contractual Remedies Act 1979; s 45A Credit Contracts Act 1981; and s 11 Contracts (Privity) Act 1982.;

  • An item relating to the Credit Contracts Act 1981 was repealed, as from 1 April 2005, by section 139 Credit Contracts and Consumer Finance Act 2003 (2003 No 52). See sections 141 to 143 of that Act as to the transitional provisions.

  • An item relating to the Hire Purchase Act 1971 was repealed, as from 1 April 2005, by section 139 Credit Contracts and Consumer Finance Act 2003 (2003 No 52). See sections 141 to 143 of that Act as to the transitional provisions.
