91 Immigration visa not required

(1)

If a person is—

(a)

surrendered or temporarily surrendered to New Zealand in relation to an extradition offence; or

(b)

a person to whom section 90 applies,—

that person is not required to hold a visa under the Immigration Act 2009 if, and for so long as, the person is in New Zealand in accordance with the provisions of this Act.

(2)

If a person is returned to New Zealand to continue serving a sentence of imprisonment after being temporarily surrendered to an extradition country under Part 3 or Part 4, the status of the person for the purposes of the Immigration Act 2009 is not affected by the fact that the person was temporarily surrendered.
