134 Offence of breach of duty

(1)

A person commits an offence who, without reasonable excuse,—

(a)

being the operator of a risk management programme, breaches or fails to carry out any of the duties specified in section 16; or

(b)

being a recognised agency, breaches or fails to carry out any of the duties specified in section 112G; or

(c)

being a recognised person, breaches or fails to carry out any of the duties specified in section 112H; or

(d)

being a registered exporter, breaches or fails to carry out any of the duties specified in section 51.

(2)

A person who commits an offence under subsection (1) is liable on conviction to—

(a)

in the case of a body corporate, a fine not exceeding $200,000:

(b)

in the case of an individual, a fine not exceeding $50,000.
