Fire Service Amendment Act 2000: repealed, on 1 July 2017, pursuant to section 195(a) of the Fire and Emergency New Zealand Act 2017 (2017 No 17).

This Act is administered in the Department of Internal Affairs.

The Parliament of New Zealand enacts as follows:

 
1 Title

(1)

This Act is the Fire Service Amendment Act 2000.

(2)

In this Act, the Fire Service Act 1975 is called “the principal Act”.

2 Commencement

This Act comes into force on the day after the date on which it receives the Royal assent.

3 Members of Commission

(1)

Section 6(1)(a) of the principal Act is amended by omitting the word “Three”, and substituting the expression “5”.

(2)

Despite section 7 of the principal Act, with respect to the 2 members of the Fire Service Commission first appointed after the commencement of this Act,—

(a)

the initial term of office for 1 member is 18 months; and

(b)

the initial term of office for the other member is 2 years.

(3)

Section 6(1)(b), (3), (4), and (5) of the principal Act is repealed.

4 Meetings of Commission

Section 11(2) of the principal Act is amended by omitting the expression “2”, and substituting the expression “3”.

5 Consequential amendments

(1)

Section 2 of the principal Act is amended by repealing the definition of appointed member.

(2)

Sections 6(2)(b) and (c), 8(1) and (2), and 10(1) of the principal Act are amended by omitting the word “appointed” wherever it occurs.

(3)

Sections 7, 8(3), and 9(1) of the principal Act are amended by omitting the words “appointed member” wherever they occur, and substituting in each case the word “member”.

(4)

Section 9(1) of the principal Act is amended by omitting the words “appointed member’s”, and substituting the word “member’s”.

(5)

Section 58B(2) of the principal Act is amended by omitting the words “an appointed”, and substituting the word “a”.

6 Consequential repeal

Section 9(2) of the principal Act is repealed.

7 Repeal of spent provisions

(1)

Section 6(7) of the principal Act is repealed.

(2)

The proviso to section 7 of the principal Act is repealed.
