The Parliament of New Zealand enacts as follows:

1 Title
  • (1) This Act is the Sale of Liquor Amendment Act 2001.

    (2) In this Act, the Sale of Liquor Act 1989 is called the principal Act.

2 Commencement
  • This Act comes into force on the day after the date on which it receives the Royal assent.

3 Term of office of members of Authority
  • (1) Section 86 of the principal Act is amended by repealing subsection (1), and substituting the following subsections:

    • (1) Except as otherwise provided in this Act, a member of the Licensing Authority holds office for a term stated by the Governor-General on his or her appointment. A member may be reappointed.

    • (1A) Except as provided in subsection (1B), the term stated must be 5 years.

    • (1B) The term stated may be less than 5 years if—

      • (a) at the time of the appointment concerned—

        • (i) 2 or 3 members hold office; and

        • (ii) each of them was appointed for a term of 5 years; and

      • (b) only 1 member is appointed at that time.

    (2) Subsections (1) and (1B) of section 86 of the principal Act apply to a member of the Licensing Authority holding office immediately before the commencement of this Part as if he or she had been appointed for a term of 5 years.
