Commerce Amendment Act 2004

The Parliament of New Zealand enacts as follows:

1 Title
  • (1) This Act is the Commerce Amendment Act 2004.

    (2) In this Act, the Commerce Act 1986 is called the principal Act.

2 Commencement
  • This Act comes into force on the day after the date on which it receives the Royal assent.

3 Associate members
  • (1) Section 11(3) of the principal Act is amended—

    • (a) by inserting, after the words under this Act, the words or any other Act ; and

    • (b) by omitting the words to a member shall, and substituting the words or in any other Act to a member of the Commission must.

    (2) For the avoidance of doubt, any appointment made before the commencement of this Act under section 11 of the principal Act is valid and effective whether or not it relates to a matter or class of matters under an Act other than the principal Act.

4 Meetings of Commission
  • (1) Section 15(1) of the principal Act is amended by adding the words or any other Act.

    (2) Section 15 of the principal Act is amended by repealing subsection (2), and substituting the following subsections:

    • (2) Meetings of the Commission are to be held at the places, dates, and times, and by the methods, that the Chairman determines.

    • (2A) A meeting of the Commission may be held either—

      • (a) by a quorum of members being assembled together at the place, date, and time appointed for the meeting; or

      • (b) by means of audio, or audio and visual, communication by which a quorum of members can simultaneously hear each other throughout the meeting.

    (3) Section 15(4) of the principal Act is amended by omitting the words , or of any separate Division of the Commission acting under section 16(1) of this Act,.

5 Chairman may direct Commission to sit in Divisions
  • (1) Section 16(1) of the principal Act is amended by inserting, after the words under this Act, the words or any other Act.

    (2) Section 16(6) of the principal Act is amended by inserting, after the words under this Act, the words or any other Act.
