4 New sections 46AB and 46AC inserted
  • The following sections are inserted after section 46A:

    46AB Application of section 45 during epidemic
    • (1) While an epidemic management notice is in force, section 45 has effect as if the reference in it to a longer period than 8 days were a reference to a longer period than 21 days.

      (2) If the notice applies to only stated parts of New Zealand, subsection (1) applies within those parts only.

      (3) In subsection (1), epidemic management notice means a notice under section 8(1) of the Epidemic Preparedness Act 2006 stating that the application of this Act is modified in order to deal with the practical effects of the outbreak of the disease referred to in the notice.

    46AC Application of section 46 during epidemic
    • (1) While an epidemic management notice (within the meaning of section 46AB(3)) is in force, section 46 has effect as if—

      • (a) the references in paragraphs (a) and (b) of subsection (3) to 8 days have effect as if they are references to 21 days; and

      • (b) the reference in subsection (3)(c)(i) to the earliest opportunity has effect as if it is a reference to the earliest opportunity that is reasonable in all the circumstances; and

      • (c) the reference in subsection (3)(c)(ii) to the earliest opportunity after the expiration of 16 days commencing on the date of the imposition of the remand has effect as if it is a reference to the earliest opportunity after the expiration of 42 days commencing on the date of the imposition of the remand that is reasonable in all the circumstances.

      (2) If the notice applies to only stated parts of New Zealand, subsection (1) applies within those parts only.
