Immigration Advisers Licensing Act 2007

75 Time for filing charging document

Despite anything to the contrary in section 25 of the Criminal Procedure Act 2011,—

(a)

a charging document may be filed at any time in respect of an offence against any of sections 63(1)(a), 64(1), 65(1), 67(1)(a), and 68(1)(a); and

(b)

the limitation period in respect of an offence against any other offence against this Act ends on the date that is 2 years after the earlier of—

(i)

the date when the incident, situation, or set of circumstances to which the offence relates first became known to an employee of the Department responsible for the enforcement of this Act; or

(ii)

the date when the incident, situation, or set of circumstances to which the offence relates should reasonably have become known to such an employee.
