(1) Except as provided in subsection (2), every offence against this Act is punishable on summary conviction.
(2) An offence against any of sections 63(1)(a), 64(1), 65(1), 67(1)(a), and 68(1)(a) is punishable on conviction on indictment.
(3) Despite section 14 of the Summary Proceedings Act 1957, an information for an offence against this Act punishable on summary conviction may be laid at any time within 2 years after the earlier of—
(a) the date when the incident, situation, or set of circumstances to which the offence relates first became known to an employee of the Department responsible for the enforcement of this Act; or
(b) the date when the incident, situation, or set of circumstances to which the offence relates should reasonably have become known to such an employee.
