Section 191 is repealed and the following section substituted:
“191 Recording of communication work for archival purposes“(1) Any person (A) who records, or makes a copy of a recording of, a communication work does not infringe any right under this Part in relation to a performance or recording included in the communication work if—“(a) the communication work falls within a prescribed class; and“(b) A makes the recording or the copy for the purpose of it being placed in an archive maintained by a prescribed body.“(2) A body must not be prescribed for the purposes of subsection (1) if it is established or conducted for profit.”
