7 Procedure for making ordinary rules
  • (1) Section 34 is amended by repealing subsection (1) and substituting the following subsection:

    • (1) Before making any ordinary rule, the Minister must, as the Minister in each case considers appropriate,—

      • (a) publish a notice of his or her intention to make the rule; and

      • (b) consult—

        • (i) the persons, representative groups within the aviation industry or elsewhere, government departments, and Crown agencies; and

        • (ii) the Environmental Risk Management Authority, established under the Hazardous Substances and New Organisms Act 1996, about the contents of any rule that relates to the transportation of hazardous substances as defined in section 2(1) of that Act.

    (2) Section 34(3) is amended by omitting the persons so notified and substituting each person so notified (with effect from service of the rule on the person).

    (3) Section 34(4) is repealed.
