104 Who decides application for licence

(1)

A licensing committee may decide any application for a licence.

(2)

With the leave of the chairperson of the licensing authority, a licensing committee may refer an application for a licence to the authority for decision.

(3)

The licensing committee must give the licensing authority the complete file relating to any application for a licence to be decided by the authority. The complete file means—

(a)

the application and any papers filed in support of it; and

(b)

a copy of the public notice of the application, and a statement of the dates of publication of the notice; and

(c)

any objection, and any papers filed in support of it; and

(d)

any reports made under section 103; and

(e)

the certificate referred to in section 100(f).
