An affordable housing policy must state the criteria to be applied to decide who is to be allocated affordable housing.
(2) The policy must state the following criteria:
(a) that the income of a person’s household is low to moderate:
(b) that, if a person were allocated affordable housing, the person’s household would be able to meet—
(i) their housing costs:
(ii) their other essential basic living costs:
(c) that a person does not have a legal or beneficial interest in property of such value as to make it inappropriate for the person to be allocated affordable housing:
(d) that, if another person in a person’s household has a legal or beneficial interest in property, the combination of the relationship of the persons and the value of the property does not make it inappropriate for the person to be allocated affordable housing.
(3) The policy must also state the method by which the authority determines whether the criteria listed in subsection (2) apply to a person.
(4) An affordable housing policy may state a criterion that—
(a) is not listed in subsection (2):
(b) is reasonable in the circumstances of the authority.
