(1) This section amends the Soil Conservation and Rivers Control Act 1941.
(2) Section 54 is amended by repealing paragraph (c) and substituting the following paragraph:
“(c) any person who is subject to a property order made under section 30 or 31 of the Protection of Personal and Property Rights Act 1988.”
(3) Section 55(1) is amended by repealing paragraph (c) and substituting the following paragraph:
“(c) is or becomes, due to disability, unable to carry out his or her duties as a member; or”.
(4) Section 55 is amended by adding the following subsection:
“(4) For the purposes of subsection (1)—“(a) disability has the meaning given by section 21(1)(h) of the Human Rights Act 1993; and“(b) a person who becomes subject to a property order made under section 31 of the Protection of Personal and Property Rights Act 1988 is to be treated as falling within subsection (1)(c) (whether or not the person has a disability).”
“(4) For the purposes of subsection (1)—
“(a) disability has the meaning given by section 21(1)(h) of the Human Rights Act 1993; and
“(b) a person who becomes subject to a property order made under section 31 of the Protection of Personal and Property Rights Act 1988 is to be treated as falling within subsection (1)(c) (whether or not the person has a disability).”
