Section 172 is amended by repealing subsection (1) and substituting the following subsection:
“(1) If the owner of an animal is convicted of an offence against this Act in respect of that animal, the court may,—“(a) if it thinks it desirable for the protection of the animal (in addition to or in substitution for any other penalty), order that the animal be forfeited to the Crown or to an approved organisation:“(b) if it thinks it desirable (in addition to or in substitution for any other penalty), order that any proceeds of sale of the animal retained under section 136A be forfeited to the Crown.”
“(1) If the owner of an animal is convicted of an offence against this Act in respect of that animal, the court may,—
