(1) Section 39(1) is amended by omitting “any Justice or any Community Magistrate or any Registrar (not being a member of the police), who, on application in writing made on oath”
and substituting “any issuing officer (within the meaning of section 3 of the Search and Surveillance Act 2009) who, on application in writing verified in accordance with section 97 of that Act”
.
(2) Section 40(1) is amended by omitting “any Justice or any Community Magistrate or any Registrar (not being a member of the police), may, on application in writing made on oath”
and substituting “any issuing officer (within the meaning of section 3 of the Search and Surveillance Act 2009) may, on application in writing verified in accordance with section 97 of that Act”
.
(3) Section 386(1) is amended by omitting “Any Judge or Justice or Community Magistrate or any Registrar (not being a member of the police) who, on application in writing made on oath”
and substituting “An issuing officer (within the meaning of section 3 of the Search and Surveillance Act 2009) who, on application in writing verified in accordance with section 97 of that Act”
.
