Recommendation

The Regulations Review Committee has examined the Secondary Legislation Bill and recommends that it be passed with the amendments shown.

Introduction

This omnibus bill seeks to improve and support the law relating to the making of secondary legislation. (That is, the regulations and other types of law that are made under powers delegated by Parliament to the Governor-General, Ministers, officials, and agencies.)

The bill would apply the framework for access to and scrutiny of secondary legislation that was provided for in the Legislation Act 2019. That Act responded to recommendations made in 2014 by the Regulations Review Committee.1 It established a single category of secondary legislation, replacing the previous complicated definitions of legislative and disallowable instruments.

The bill would amend over 2,500 existing provisions, in more than 550 Acts, which delegate power to make secondary legislation. It would also create a limited number of new exemptions from the disallowance, publication, presentation, and listing requirements that apply to secondary legislation under the processes provided for in the bill.

An extensive consultation period has enabled relevant government agencies to identify the instruments they are responsible for, and classify them as secondary legislation if appropriate. The general approach in preparing the bill has been to categorise instruments that are disallowable under the Legislation Act 2012 as secondary legislation.

Secondary legislation is subject to parliamentary oversight and scrutiny. The intent of this bill is for all instruments that have legislative effect to be labelled as secondary legislation. This would assist Parliament to scrutinise its delegated powers by ensuring that secondary legislation is easily identified.

Proposed amendments

This commentary covers the main amendments we recommend to the bill as introduced. We do not discuss minor or technical amendments.

Instruments that are exempt from requirements regarding publication, listing, presentation, and disallowance

The bill as introduced lists a number of empowering provisions that would allow secondary legislation to be made that was exempt from requirements regarding publication, listing, presentation, or disallowance. A list of these exemptions is in Schedule 35 and 36 of the bill as introduced.

We chose to focus our consideration on new exemptions proposed in the bill, and exemptions for which the current legislation is unclear. We also decided not to examine exemptions for instruments that are made by the House; that are about member’s salaries, entitlements, and allowances; or that involve judicial salaries. We consider these exemptions appropriate. In the case of the first, Parliament does not need to scrutinise its own legislation. For the others, Parliament has already established that the instrument should be made by a more appropriate entity, separately from Parliament.

During the select committee process we heard submissions from government agencies that are responsible for the Acts under which these instruments are made. We considered it important to seek clarification from each responsible agency that exemptions are still required for the effective operation of the relevant instruments. If the exemption was not justified, we are recommending that the instrument be removed from the list of exemptions. As introduced, the bill would exempt these instruments from appropriate parliamentary scrutiny without good reason for such an exemption.

Instruments empowered by certain sections of the Telecommunications Act 2001

As introduced, the bill would exempt from presentation requirements any instruments empowered by sections 27, 30M, 30R, 39, 51, 58, 59, 87, 94J, 170(1), 188, 222, 236, 238, clauses 10 and 17 of Schedule 2, and clause 3 of Schedule 2A of the Telecommunications Act 2001. The agency responsible for this Act is the Ministry of Business, Innovation and Employment. The Act provides the Commerce Commission with various powers to make determinations and codes.

These exemptions were included in the bill as introduced to preserve the Commerce Commission’s independence in making these determinations and codes.

We are not persuaded that this is necessary, and recommend removing the presentation exemptions for any instruments made by the Commerce Commission under the Telecommunications Act 2001 and the Commerce Act 1986. We do not consider that subjecting the Commerce Commission to the usual presentation requirements of secondary legislation would harm its independence.

Presentation is a key mechanism through which Parliament can monitor the Executive’s use of delegated power. We note that parliamentary scrutiny of such instruments does not generally concern a review of the policy underpinning the instruments. Rather, the scrutiny is to examine whether the instruments have been made in accordance with Parliament’s intention when it delegated its law-making function. If the instruments are inconsistent with Parliament’s intention, the Commerce Commission would be acting outside the intended scope of the empowering provisions.

Presentation requirements facilitate Parliament having this oversight. The intention of Parliament was to ensure that these matters are dealt with by the technical expertise of the Commerce Commission, which would continue provided they are in line with the intentions of the empowering provision. Our recommendation would remove the presentation exemptions in Schedule 36 of the bill for the listed empowering provisions in the Telecommunications Act.

Instruments empowered by section 387(4)(b) of the Food Act 2014

In the bill as introduced, instruments empowered by section 387(4)(b) of the Food Act 2014 are included in the list of exemptions from disallowance and presentation in Schedule 36. Under this provision, the chief executive of the Ministry for Primary Industries may issue notices relating to the categorisation of imported foods. Currently, these instruments are excluded from disallowance and are not required to be presented to the House.

We consider the exemptions from parliamentary scrutiny wider than necessary. Notices may be issued, under section 387(4)(b) of the Food Act, to a specific importer, and therefore do not have significant legislative effect. For these notices, it is appropriate that they not be subject to parliamentary scrutiny. However, notices that apply broadly, and not to a specific importer, are genuine secondary legislation. Therefore they should be subject to the same mechanisms of parliamentary scrutiny as other secondary legislation.

We recommend removing the presentation and disallowance exemptions for the Food Act in Schedules 35 and 36 of the bill. We also recommend amending Schedule 8 to insert our amended section 387(5)(b) into the Food Act. Our amendment would provide that all notices issued under section 387(4)(b) of the Food Act are secondary legislation unless they apply only to one or more named persons.

Alternative mechanisms for parliamentary scrutiny

During our examination of this bill we heard submissions from various government agencies regarding instruments that are justifiably exempt from presentation requirements. Presentation exemptions are often to ensure confidentiality. For some instruments, confidentiality is an operational necessity. This could be for a range of reasons, such as commercial sensitivity, or national security.

For example, the bill currently provides for an exemption from presentation in respect of instruments made under section 131(2) or (3) of the Biosecurity Act 1993. The Ministry for Primary Industries considers that presentation would, in some cases, result in the disclosure of commercially sensitive information. Disclosure of commercially sensitive information could prejudice New Zealand’s overseas market access.

However, the presentation of instruments to the House is an essential component of Parliament’s scrutiny of secondary legislation, and should not be bypassed lightly. In particular, presentation is an obligation on a Minister and is a key way of establishing Ministerial accountability for the Executive’s use of the power delegated to it by Parliament to make secondary legislation.

As previously discussed, we examined the current provisions that enable presentation exemptions. Of the instruments that would still be exempt from presentation requirements under the bill, we are satisfied that the exemptions are justified. However, we consider that a mechanism is needed to allow Parliament to monitor how frequently delegated powers to make instruments that are subject to presentation exemptions are used.

We recommend amending Schedule 33 of the bill to insert new section 83A into the Legislation Act 2019. Our amendment would require the Chief Parliamentary Counsel to prepare a yearly report that sets out the extent to which makers of secondary legislation have relied on presentation exemptions during the previous financial year and any other practices relating to the design, drafting, and publication of legislation that the Chief Parliamentary Counsel may want to include in the report. Our amendment would require the Attorney-General to present this report to the House.

We also recommend that the Standing Orders Committee consider amending the Standing Orders to provide for a procedure where the report of the Chief Parliamentary Counsel is referred to the Regulations Review Committee for consideration after it is presented. We consider that this report would provide a basis for the Regulations Review Committee to make further enquiries of agencies responsible for instruments that are subject to presentation exemptions, consider whether these exemptions remain appropriate, and report to the House on these findings. This would provide an effective mechanism to ensure continuing oversight of the use of these exemptions.

When a presentation exemption may be acceptable

We considered when it may be appropriate for secondary legislation to be exempt from the usual requirement to present to the House. As previously discussed, the requirement to present secondary legislation is an essential way of ensuring that Parliament can scrutinise what is done with the power it has delegated. Therefore, anything that limits Parliament’s ability to perform this essential function must be justifiable. Our position is that this exemption may be acceptable on two grounds, discussed below.

One ground is if the secondary legislation contains sensitive information, and there is a compelling need to protect that information from public disclosure. This may be appropriate if it has been determined that it is necessary to exempt secondary legislation from publication. For example, this would be the case if the public disclosure of certain secondary legislation is prejudicial to national security. An exemption from presentation may be acceptable if presentation to the House would create an unacceptable risk of the public disclosure, as this would undermine the publication exemption.

However, presentation results in a more limited distribution than that entailed by publication. Therefore, the fact that a publication exemption is necessary does not automatically justify a presentation exemption. The risks associated with presentation should be evaluated separately, taking into account the particular nature of how information is disclosed if it is presented to the House.

The second ground on which a presentation exemption may be justified is if the maker of that secondary legislation must be seen to be acting independently of the House. Presentation is a symbolic act of accountability to the House. It may not be appropriate for an organisation that Parliament has intended should be independent of Parliament’s scrutiny, even on the limited grounds for disallowance, to then be held accountable to it through a presentation requirement.

For example, the Remuneration Authority determines judicial salaries. The absence of an obligation to present underscores the Authority’s independence from the House. When Parliament passed the Act that empowered the Remuneration Authority to determine these salaries, it intended this body to do so independent from parliamentary scrutiny.

This second justification for a presentation exemption would exist even if an exemption from publication was not justified.

The commencement of rules empowered by section 243 of the Gambling Act

Schedule 3 of the bill would amend section 243 of the Gambling Act 2003, which empowers the Lotteries Commission to make rules for lotteries. Schedule 3 of the bill is worded so that rules made by the Lotteries Commission would commence at the start of the day on which they are published. They would therefore have retrospective effect between the start of that day and the time of publication.

We recommend changing the amendment to section 234(7)(b) of the Gambling Act so that any rules take effect “from” a particular day. This would mean that any rules made under this provision would come into force at the start of the following day, ensuring that they were not retrospective.

Consistency of wording for publication provisions

The bill as introduced uses two different formulations regarding the publication of instruments made by the House. Amendments that would require the Clerk of the House to lodge a copy of the resolution with the PCO in some cases specify “for the purposes of its publication under the Legislation Act 2019”, and in other cases “for publication under Part 3 of that Act”.

There is no valid reason for the difference in wording. For the sake of consistency and clarity, we recommend amending Schedules 10, 14, 16, and 24 of the bill so that consistent wording is adopted in relation to publication requirements for instruments made by the House.

Updating the bill between introduction and commencement

The bill as introduced amends each provision in the statute book made prior to 1 June 2019 that empowers instruments to be made that have legislative effect. It does this by stating that those instruments are secondary legislation. We recommend amending the bill so that provisions that empower the making of secondary legislation, which were enacted between 1 June 2019 and 31 December 2019, are also included in the bill. Our amendment would categorise a further 50 empowering provisions, in 35 Acts (including 9 newly-enacted principal Acts), as ones that empower the making of secondary legislation.

We note that, after this report to the House, further amendments will be needed if the bill is to remain up to date. They would ensure that the bill includes empowering provisions to make secondary legislation that are enacted after 31 December 2019 and before the commencement of the bill. These amendments are expected to be made using the following methods:

  • inserting self amending provisions into bills that are not yet passed at the time of the Committee of the whole House stage of this bill

  • releasing a Supplementary Order Paper at the Committee of the whole House stage of the Secondary Legislation Bill to bring the bill up to date for Acts already passed in 2020

  • using the existing transitional regulation‐making power in the Legislation Act 2019 to amend empowering provisions to correctly reflect whether or not they create secondary legislation.

Instruments empowered by section 65AQ of the Racing Act

We recommend a change to the bill to provide an exemption from presentation for secondary legislation empowered by section 65AQ of the Racing Act 2003. This section of the Act was created by the Racing Reform Act 2019, enacted on 26 June 2019. The bill as introduced only captured provisions in the statute book that were enacted before 1 June 2019.

Section 65AQ of the Racing Act empowers the relevant Minister to exempt offshore betting operators from the need to comply with certain requirements of the Act. If secondary legislation empowered by this provision contains commercially sensitive information, that information is exempt from publication requirements.

We propose amending Schedule 36 by adding secondary legislation, empowered by section 65AQ of the Racing Act, to the list of presentation exemptions. This would avoid undermining the current publication exemption.

Transitional regulation-making power in the Legislation Act 2019

It has become clear to us that the existing transitional regulation‐making power in the Legislation Act 2019 is not sufficient to keep the statute book up to date. Schedule 33 of the bill sets out amendments to the Legislation Act 2019, including amendments to the transitional regulation-making powers in clause 19 of Schedule 1 of the Act. We recommend making changes to the transitional regulation‐making power as outlined below.

We recommend removing the requirement for the Governor-General to make a separate declaration of legislative status under clause 19 of Schedule 1 of the Legislation Act. We think that the intent of this provision could be achieved by simply making the amendments needed to include or exclude instruments from the category of secondary legislation and consider the requirement for a separate declaration to be unnecessary and potentially confusing.

We also recommend amending clause 19 so that it is sufficiently broad to provide for the full range of consequential and related amendments that may need to be made. In the process of updating the bill to reflect changes to the statute book, amendments have been needed that the power as currently drafted would not be able to provide for.

Finally, we recommend amending clause 19 to ensure that the transitional regulation-making powers capture royal prerogative instruments and allow for references to such instruments to be added and removed from the relevant schedules.

Further changes based on the Transport and Infrastructure Committee’s report on the Racing Industry Bill

Clause 28 of the Racing Industry Bill provides that racing codes may make rules regulating the conduct of racing. The rules are not classified as secondary legislation. Clause 30(3) of the Racing Industry Bill states that these rules are contractual in nature and are neither a legislative instrument nor a disallowable instrument, and do not need to be presented to the House. Therefore, they are not a delegation of Parliament’s law-making power.

We wrote to the Transport and Infrastructure Committee, which was due to report back to the House on the Racing Industry Bill by 1 June 2020. We have asked that committee to consider whether the content of the racing rules have a character for which the scrutiny of Parliament would be appropriate via disallowance.

If it is not appropriate for the rules to be subject to disallowance, we have asked the committee to consider whether it remains necessary for the Racing Industry Bill to provide a power to make racing rules in light of their contractual nature.

Given the likely timing of the committee’s report to the House on the Racing Industry Bill, any consequent changes to the Secondary Legislation Bill would need to be made at the Committee of the whole House stage.

If the Transport and Infrastructure Committee considers that the rules should remain disallowable, we recommend that the House amend the Secondary Legislation Bill so that the rules made under clause 28 of the Racing Industry Bill would be classified as secondary legislation. This would be consistent with the way other disallowable instruments have been classified.

If, however, the committee recommends that the rules should continue to be not subject to disallowance, there would be no need to amend the Secondary Legislation Bill.

This Act is the Secondary Legislation Act 2019.

2 Commencement

(1)

This Act comes into force—

(a)

on 1 or more dates set by Order in Council; or

(b)

to the extent not brought into force earlier, on the fifth anniversary of the date of Royal assent.

One or more Orders in Council may set different dates for different provisions (and, for that purpose, may commence a provision only for the purpose of giving effect to some, but not other, parts of this Act).
