Explanatory note

General policy statement

The purpose of this Bill is to enable Boards of Trustees to manage their own affairs by having full control over the employment of teachers at their school.

Clause by clause analysis

Clause 1 is the Title clause.

Clause 2 provides that the Bill comes into force on the day after the date on which it receives the Royal assent.

Clause 3 provides that the Bill amends the Education Act 1989 (the principal Act).

Clause 4 sets out the purpose of the Bill.

Clause 5 provides that the Bill binds the Crown.

Clause 6 inserts a new section 91.

Clause 7 repeals section 81A.

Clause 8 repeals sections 91A to 91C and 91F to 91N.

The Parliament of New Zealand enacts as follows:

1 Title

  • This Act is the Education (Board of Trustee Freedom) Amendment Act 2010.

2 Commencement

  • This Act comes into force on the day after the date on which it receives the Royal assent.

3 Principal Act amended

  • This Act amends the Education Act 1989.

4 Purpose

  • The purpose of this Act is to enable Boards of Trustees to manage their own affairs by administering the employment of teachers at their school.

5 Act binds the Crown

  • This Act binds the Crown.

6 New section 91 inserted

  • The following section is inserted after section 89:

    “91 Payment of teachers out of grants

    • “(1) The Board of every school is to pay, out of grants paid to it under section 79, the salaries of all teachers employed at the school.

      “(2) Subject to Part 10, the provisions of the Employment Relations Act 2000 and the State Sector Act 1988, Boards may negotiate the employment of teachers on any terms and conditions of employment as they see fit.”

7 Section 81A repealed

  • Section 81A is repealed.

8 Sections 91A to 91C and 91F to 91N repealed

  • Sections 91A to 91C and 91F to 91N are repealed.
