Explanatory note

General policy statement

The purpose of this Bill is to amend the Crimes Act 1961 to increase the penalty for providing explosives to commit an offence from a maximum of 2 years to a maximum of 5 years imprisonment.

Currently under section 272 of the Crimes Act 1961, individuals who knowingly make or possess an explosive substance, dangerous engine, instrument, or thing with the intent to use or enable another person to use such to commit an offence are liable to a maximum of 2 years in imprisonment.

The maximum term of imprisonment is low for the type of offending compared with other offences relating to weapons or explosives.

Clause by clause analysis

Clause 1 is the Title clause.

Clause 2 is the commencement clause. It provides that the Bill comes into force on the day after the date on which it receives the Royal assent.

Clause 3 provides that the Bill amends the Crimes Act 1961 (the principal Act).

Clause 4 sets out the purpose of the Bill, which is to increase the penalty for providing explosives to commit crime from a maximum of 2 years to a maximum of 5 years’ imprisonment.

Clause 5 amends section 272 to increase the penalty for providing explosives to commit crime from a maximum of 2 years to a maximum of 5 years’ imprisonment.

The Parliament of New Zealand enacts as follows:

1 Title

This Act is the Crimes (Increased Penalty for Providing Explosive to Commit Crime) Amendment Act 2016.

2 Commencement

This Act comes into force on the day after the date on which this Act receives the Royal assent.

3 Principal Act

This Act amends the Crimes Act 1961 (the principal Act).

4 Purpose

The purpose of this Act is to increase the penalty for providing explosives from a maximum of 2 years to a maximum of 5 years’ imprisonment.

5 Section 272 amended (Providing explosive to commit crime)

In section 272, replace “2 years” with “5 years”.
