PURSUANT to the Cook Islands Act 1915, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following Order.

  • This Order may be cited as the Cook Islands Applied Regulations Order 1947.

  • In this Order the term applied regulations means any regulations (being regulations applying to New Zealand) which are for the time being in force in the Cook Islands, whether by virtue of this Order or by virtue of any Act or other enactment.

  • The regulations specified in the Schedule hereto shall be in force in the Cook Islands, subject to the modifications hereinafter directed to be made.

  • For the purposes of the application of any applied regulations to the Cook Islands, unless otherwise expressly provided or unless the context otherwise requires, the following provisions shall apply:—

    • (a) The revocation in its application to New Zealand of any applied regulation shall not affect the continuance thereof in the Cook Islands:

    • (b) Any references, express or implied, in applied regulations to New Zealand as a territorial expression shall, in the application thereof to the Cook Islands other than Niue, be deemed to be references to the Cook Islands, and shall in the application thereof to the Island of Niue be deemed to be references to the Island of Niue:

    • (c) Any references in applied regulations to the Governor-General or to a Minister of the Crown shall, in the application thereof to the Cook Islands other than Niue, be deemed to be references to the Resident Commissioner of Rarotonga, and shall in the application thereof to the Island of Niue be deemed to be references to the Resident Commissioner of Niue:

    • (d) Any reference in applied regulations to a particular Department or officer of the Government shall be deemed to be a reference to the appropriate or equivalent Department or officer of the local Administration, or, if there is no such appropriate or equivalent Department or officer, shall, in the application thereof to the Cook Islands other than Niue, be deemed to be a reference to the Resident Commissioner of Rarotonga, and shall in the application thereof to the Island of Niue be deemed to be a reference to the Resident Commissioner of Niue:

    • (e) If any question arises as to what is the appropriate or equivalent Department or officer of a local Administration or whether there is such an appropriate or equivalent Department or officer, the question may be decided respectively for the Cook Islands other than Niue, and for Niue, by notice given by the Resident Commissioner of Rarotonga, and by the Resident Commissioner of Niue, respectively acting in an executive capacity:

    • (f) Any reference in applied regulations to a Court shall be deemed to be a reference to the High Court of the Cook Islands.

  • The Control of Prices Emergency Regulations 1939 shall, in their application to the Cook Islands, have effect as if they had been amended by adding to subclause (1) of regulation 13 the following paragraph:

    • (e) To exempt from time to time, by notice given in such manner as it thinks fit, any goods, or goods belonging to a specified kind or class, from the operation of these regulations.

    This regulation was inserted, as from 21 October 1953, by regulation 2 Cook Islands Applied Regulations Order 1947, Amendment No 2 1953 (SR 1953/132).

  • This Schedule was amended, as from 3 March 1952 by regulation 3 Cook Islands Applied Regulations Order 1947 Amendment No 1 (SR 1952/23) by inserting items relating to Amendments Nos 5 to 8 of the Enemy Property Regulations 1939.

  • This Schedule was further amended, as from 21 October 1953, by regulation 3 Cook Islands Applied Regulations Order 1947, Amendment No 2 (SR 1953/132) by revoking the items which related to the Price Stabilization Emergency Regulations 1939 and Amendment No 1 to those regulations.

  • This Schedule was further amended, as from 3 March 1954, by the Schedule to the Revocation of Enemy Property Emergency Regulations 1954 (SR 1954/31) by revoking the items which related to the Enemy Property Emergency Regulations 1939 and amendments to those regulations.

  • This Schedule was further amended, as from 18 May 1966, by regulation 2 Cook Islands and Niue Regulations Revocation Order 1966 (SR 1966/68) by revoking the items which related to the Defence Emergency Regulations 1939 and Amendment No 1 of those regulations, the Enemy Trading Emergency Regulations 1939 and Amendments Nos 1 and 2 of those regulations, and the Export Prohibition Emergency Regulations 1939 and Amendment No 1 of those regulations.
