PURSUANT to the Forests Act 1949, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following regulations.

  • (1) These regulations may be cited as the Forest Service Fees and Charges Regulations 1953.

    (2) These regulations shall come into force on the day after the date of their notification in the Gazette.

  • The Minister of Forests may charge the fees specified in the Schedule to these regulations in respect of the documents under the Forests Act 1949 specified in that Schedule (being documents issued or effected after the commencement of these regulations), whether or not any fees were payable in respect of similar documents before the commencement of these regulations.

  • The Minister in his discretion may in any case where he considers it reasonable and equitable to do so reduce any fee set forth in the Schedule to these regulations, or waive payment of any such fee, or refund out of moneys appropriated by Parliament for the purpose to the person paying any such fee the whole or any part of the fee.

  • The following regulations are hereby revoked:

    • (a) The regulations made under the State Forests Act 1908 on the 31st day of March 1909 and published in the Gazette on the 15th day of April in that year at page 1031:

    • (b) The regulations made under the State Forests Act 1908 on the 30th day of January 1912 and published in the Gazette on the 8th day of February in that year at page 489:

    • (c) The regulations made under the State Forests Act 1908 on the 28th day of September 1914 and published in the Gazette on the 1st day of October in that year at page 3661:

    • (d) The regulations made under Part 7 of the Forests Act 1921-22 on the 21st day of September 1925 and published in the Gazette on the 24th day of September in that year at page 2646:

    • (e) The State Forest Regulations Amendment 1936 (Statutory Regulations, Serial number 104/1937).

5 Charges for draughting and technical services
  • (1) A charge calculated at the rate of $15 per hour or part thereof shall be paid to the Forest Service by any person at whose request the following work is done:

    • (a) The preparation or compilation of any plan, map or photograph:

    • (b) The colouring or mounting of any lithograph, map, plan, tracing, photostat, or helio or other print:

    • (c) The making of any search of records.

    (2) In addition to the charge prescribed in subclause (1) of this regulation, such person shall pay the actual cost of all material properly used in the performance of that work.

    Regulations 5 and 6 were inserted, as of 19 December 1977, by regulation 2 Forest Service Fees and Charges Regulations 1953, Amendment No 2 (SR 1977/336).

    Regulation 5 was amended, as of 18 May 1981, by regulation 2 Forest Service Fees and Charges Regulations 1953, Amendment No 3 (SR 1981/122), by omitting the expression $7 and substituting the expression $15.

  • Nothing in these regulations shall be deemed to authorise any person to require the Forest Service to undertake any work that according to established practice should be undertaken on behalf of that person by a registered surveyor or draughtsman or other person.

    Regulations 5 and 6 were inserted, as of 19 December 1977, by regulation 2 Forest Service Fees and Charges Regulations 1953, Amendment No 2 (SR 1977/336).


Schedule

  • The Schedule (as substituted, as from 28 June 1976, by regulation 2 Forest Service Fees and Charges Regulations 1953, Amendment No 1 (SR 1976/182)) was substituted, as from 18 May 1981, by regulation 3 Forest Service Fees and Charges Regulations 1953, Amendment No 3 (SR 1981/122).

These regulations prescribe the fees to be paid in respect of documents issued under the Forests Act 1949, and revoke the general regulations made under the State Forests Act 1908.
