PURSUANT to the Vegetables Levy Act 1957, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following regulations.

  • These regulations may be cited as the Vegetables Levy Regulations 1958.

  • These regulations shall come into force on the day after the date of their notification in the Gazette.

  • Subject to the provisions of regulation 4 hereof, every person who, in accordance with section 3 of the Vegetables Levy Act 1957, has deducted a levy under that section shall in each month forward to the New Zealand Vegetable and Produce Growers' Federation Incorporated a return showing the total amount of all levies deducted by him as aforesaid during the previous month together with the amount of commission payable under subsection (8) of the said section 3 in respect of the levies deducted.

  • (1) Nowithstanding the provisions of regulation 3 hereof, any auctioneer or wholesaler who is a member of the New Zealand Fruit and Produce Merchants' and Auctioneers' Federation Incorporated may, in each month, instead of forwarding the return required by regulation 3 hereof, forward to that Federation the return required by regulation 3 hereof together with the total amount of all levies, less commission, deducted by him during the previous month.

    (2) The New Zealand Fruit and Produce Merchants' and Auctioneers' Federation Incorporated shall, in each month, forward to the New Zealand Vegetable and Produce Growers' Federation Incorporated the total amount of all levies received by it during the previous month together with a statement setting forth—

    • (a) The names of all auctioneers and wholesalers from whom returns of levies and commission have been received during the previous month in accordance with subclause (1) of this regulation;

    • (b) The total amount of all levies received by the New Zealand Fruit and Produce Merchants' and Auctioneers' Federation Incorporated in respect of the said returns;

    • (c) The total amount of commission payable under subsection (8) of the said section 3 in respect of the levies so received.

  • Any person who, in accordance with section 3 of the said Act, is liable to deduct any levy shall, within three months of being requested by the New Zealand Vegetable and Produce Growers' Federation Incorporated so to do, sign a statement to the effect that during his previous financial year he has deducted and paid to the Federation all levies payable by him under the said section 3 and showing the total amount of all such levies.
