PURSUANT to section 44A of the Evidence Act 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

  • This Order may be cited as the Recognition of Overseas Register Order 1959.

  • Section 44A of the Evidence Act 1908, which section was inserted by section 3 of the Evidence Amendment Act 1958, shall apply to the following countries:

    • England and Wales:

    • Northern Ireland:

    • Scotland:

    • Australian Capital Territory:

    • New South Wales:

    • Norfolk Island:

    • Northern Territory:

    • Queensland:

    • South Australia:

    • Tasmania:

    • Territory of New Guinea:

    • Territory of Papua:

    • Victoria:

    • Western Australia:

    • Fiji.

  • The said section 44A of the Evidence Act 1908 shall also apply to the registers specified in the first column of the Schedule to these regulations.

  • For the purposes of paragraph (b) of subsection (4) of the said section 44A of the Evidence Act 1908, any copy of any entry in any such register, any certified extract therefrom, and any certificate relating to any such entry, shall be certified by the official specified in the second column of the Schedule to these regulations in the manner specified in the third column of that Schedule.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations apply to the United Kingdom, Australia and Fiji the provisions as to proof of public registers contained in section 44A of the Evidence Act 1908, which section was enacted by section 3 of the Evidence Amendment Act 1958. The regulations also extend the application of section 44A to specified special registers in Australian Capital Territory, Northern Territory, and Queensland.
