PURSUANT to the Cook Islands Act 1915, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

  • (1) This order may be cited as the Niue Island Housing Loan Order 1962.

    (2) This order shall be deemed to have come into force on the 2nd day of October 1959.

  • In the financial years specified in this clause the Minister of Finance is hereby authorised and deemed to have been authorised to pay such sums as he thinks fit by way of loan out of money appropriated by Parliament for the purpose into the Niue Assembly Account pursuant to the provisions of section 60 of the Cook Islands Amendment Act 1957, but not exceeding the sum of—

    • (a) £24,000 for the financial year ending with the 31st day of March 1960:

    • (b) £17,000 for the financial year ending with the 31st day of March 1961:

    • (c) £52,500 for the financial year ending with the 31st day of March 1962:

    • (d) £43,750 for the financial year ending with the 31st day of March 1963.

  • Any sum or sums by way of loan specified in clause 2 hereof shall be paid not in lieu of but in addition to any subsidy to the Government of Niue on the cost of importing into the Island of Niue building materials manufactured in New Zealand, as appropriated by Parliament:

    Provided that the sums of loans and subsidies shall not exceed in the aggregate—

    • (a) £24,000 for the financial year ending with the 31st day of March 1960:

    • (b) £49,000 for the financial year ending with the 31st day of March 1961:

    • (c) £52,500 for the financial year ending with the 31st day of March 1962:

    • (d) £46,500 for the financial year ending with the 31st day of March 1963.

  • The Niue Island Assembly shall not be required to pay interest on any money advanced to it by the Minister of Finance pursuant to this order.

  • (1) Any sum of loan money paid under this order before the commencement of this clause and not repaid by the Niue Island Assembly before the commencement of this clause shall be deemed to be a suspensory loan repayable if demanded by the Minister of Island Territories with the consent of the Minister of Finance:

    Provided that such repayment shall not be demanded if the house rebuilding scheme in Niue is being carried out and completed to the satisfaction of the Minister of Island Territories.

    (2) If repayment of any sum of loan money is demanded pursuant to subclause (1) of this clause, it shall be repayable in such manner as the Minister of Finance directs.

    Clause 7 was substituted, as from 1 April 1964, by clause 2 Niue Island Housing Loan Order 1962, Amendment No 1 (SR 1966/164).

  • The Niue Island Housing Loan Order 19591 is hereby revoked.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order authorises payments totalling £172,000 to the Niue Assembly Account for house rebuilding purposes at Niue. It replaces the Niue Island Housing Loan Order 1959 as from its commencement, and incorporates the loan authority provided in that order.


Issued under the authority of the Regulations Act 1936.
