PURSUANT to section 6(2) of the Hire Purchase Act 1971, the Minister of Justice hereby gives the following notice.

1 Title and commencement
  • (1) This notice may be cited as the Hire Purchase (Domestic Gas Appliance Installation) Notice 1977.

    (2) This notice shall come into force on the day after the date of its notification in the Gazette.

2 Interpretation
  • In this notice gas appliance means a gas-fuelled appliance used for heating or cooking.

3 Alternative financial details
  • Where the only goods to which a hire purchase agreement relates comprise one or more gas appliances, the financial details of the transaction to be set out on the first page of the agreement may be in a form which is substantially the same as the form set out in the Schedule to this notice (instead of in a form which is substantially the same as the form set out in Part 1 of Schedule 1 to the Hire Purchase Act 1971) if—

    • (a) The gas appliance or gas appliances are being disposed of for installation in residential premises; and

    • (b) All or part of the total amount payable is being financed interest free under a scheme for the time being operated by the New Zealand Government for the installation of gas appliances in residential premises; and

    • (c) The balance payable under the agreement is not debited to a variable credit account.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice sets out the form in which financial details may be shown on the first page on any hire purchase agreement relating to a gas appliance being financed wholly or partially interest-free under the Government's scheme for the installation of gas appliances in residential premises. The form prescribed by this notice is an alternative to the form set out in Part 1 of Schedule 1 to the Hire Purchase Act 1971.
