These regulations are administered in the Department of Justice.


PURSUANT to section 122 of the Real Estate Agents Act 1976, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following regulations.

1 Title and commencement
  • (1) These regulations may be cited as the Real Estate Agents Regulations 1977.

    (2) These regulations shall come into force on the day after the date of their notification in the Gazette.

2 Interpretation
  • In these regulations—

    Board means the Real Estate Agents Licensing Board constituted under section 4 of the Act

    Prescribed fee means the appropriate fee prescribed in Schedule 2 to these regulations.

3 Forms
  • (1) The forms set out in Schedule 1 to these regulations are the forms to be used in respect of the several matters to which those forms relate.

    (2) Such variation may be made in any prescribed form as the circumstances of any particular case may require.

4 Temporary licences
  • The Board's consent under section 32 of the Act (which relates to temporary licences) shall be endorsed on the licence by the Registrar.

5 Fees
  • (1) The fees specified in Schedule 2 to these regulations are hereby prescribed as the fees payable in respect of the several matters specified in that schedule, and shall be paid at the time of making the relevant application.

    (2) Where a licence or a certificate of approval of a real estate salesman is issued after the 30th day of September in any year (not being a licence or certificate of approval granted in respect of the year commencing on the 1st day of April in that year) half only of the prescribed fee shall be payable.

6 Revocations
  • The following enactments are hereby revoked:

    • (a) The Real Estate Agents Regulations 19641:

    • (b) The Real Estate Agents Regulations 1964, Amendment No 12:

    • (c) The Real Estate Agents Act Commencement Order 19653:

    • (d) The Real Estate Agents Examination Order 19724.

Application for Real Estate Agents Licence

Section 18

APPLICATION FOR REAL ESTATE AGENTS LICENCE (To be filed in duplicate together with a declaration in support in the appropriate prescribed form) APPLICATION: is hereby made by for a licence under the Real Estate Agents Act 1976. The prescribed fee of $....... is attached, and the following particulars are supplied: 1. The name under which it is proposed to carry on business as a real estate agent is 2. In any case where the applicant proposes to have 2 or more places of business, the address which is to be the registered office of the business is 3. The address(es) of any branch office at which it is proposed to carry on business is (are) 4. The name of the person who will be in effective control of the registered place of business or of any branch office, and the place at which the person will be in effective control, are 5. Public notice of this application in the prescribed form must be published twice in a newspaper or newspapers approved for that purpose by the Registrar. 3. Where the applicant proposes to carry on business as a real estate agent under any name that is not- (a) His own name; or (b) In the case of a partnership, the name of the firm or of one of the partners; or (c) In the case of a company, the name of the company- he must seek and obtain the approval of the Board to use that name. 4. On making this application, an applicant is required by section 76 of the Act to pay to the Council of the Real Estate Institute the sum of $....... or (in the case of the applicant being a company) the sum of $....... Declaration in support of application by an individual for real estate agent's licence

NOTE- Under section 40 of the Act it is an offence punishable by a fine not exceeding $1,000 for any person to procure or attempt to procure a real estate agent's licence by making or producing, or causing to be made or produced, any fake or fraudulent representation or statement, whether verbally or in writing.

  • Form 2 was amended, as from 1 January 2004, by section 48(3) Supreme Court Act 2003 (2003 No 53) by substituting the word High for the word Supreme. See sections 50 to 55 of that Act for the transitional and savings provisions.

Consent for real estate agent to take interest in property

The property is provisionally valued at $.............. Dated at .... this ...... day of .... 19... Signature of principal NOTE- 1. No real estate agent, and no spouse or child of a real estate agent, shall, without the consent of the principal of the real estate agent, purchase or take on lease or acquire any legal or beneficial interest in the property that the real estate agent is commissioned to sell or lease. This requirement applies whether the real estate agent acts directly or indirectly and whether by himself or herself or by any partner or sub-agent. 2. Any contract made in contravention of this requirement may be set aside at the option of the principal. 3. The real estate agent must either- (a) Before seeking the consent of his or her principal; or (b) With the agreement of his or her principal, within 14 days after obtaining that consent,- obtain, at his or her own expense, an independent valuation of the property and deliver it to the principal. 4. Where the consent is given before the valuation is supplied, the form of consent must specify the provisional valuation of the property. If the valuation, when supplied, is greater than the provisional valuation, any contract to which the principal is a party and to which the consent relates may be set aside at the option of the principal.

Consent for partner or employee of real estate agent or director of a company that is a real estate agent to take interest in property
