Misuse of Drugs Order 1978


Note

This order is administered in the Department of Health.


PURSUANT to section 4 of the Misuse of Drugs Act 1975, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

1 Title and commencement
  • (1) This order may be cited as the Misuse of Drugs Order 1978.

    (2) This order shall come into force on the 7th day after the date of its notification in the Gazette.

2 Schedule 3 to Act amended
  • (1) Part 4 of Schedule 3 to the Misuse of Drugs Act 1975 is hereby amended by adding to clause 5 the words , except a mixture of a derivative of barbituric acid named or described in clause 1 of this Part of this Schedule compounded with one or more other pharmacologically active ingredients not named or described in clause 1 of this Part of this Schedule.

    (2) Part 5 of the said Schedule 3 is hereby amended by omitting clause 5, and substituting the following clauses:

    • Mixtures of a derivative of barbituric acid named or described in Part IV of this Schedule compounded with one or more other pharmacologically active ingredients not named or described in Part IV of this Schedule.

    • Substances containing any proportion of a substance mentioned in clause 1, clause 2, clause 3, clause 4, or clause 5 of this Part of this Schedule, other than a preparation or mixture named or described in Part VI of this Schedule.

    (3) Part 6 of the said Schedule 3 is hereby amended by inserting, after paragraph (a), the following paragraph:

    • (aa) Preparations containing a derivative of barbituric acid named or described in Part IV or Part V of this Schedule, in solutions containing not more than 0.5 percent of that derivative of barbituric acid.

    (4) The said Part 6 is hereby further amended by inserting, after paragraph (f), the following paragraph:

    • (ff) Preparations of propiram containing not more than 100 mg of propiram per dosage unit and compounded with at least the same amount of methylcellulose.

    Refer to regulation 2(3) and (4) Misuse of Drugs Order 1982 (SR 1982/259); 5 and 6 in regulation 2(2) were further amended and reprinted in their amended form in Schedule 3 of the Misuse of Drugs Act 1975.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order is made pursuant to section 4 of the Misuse of Drugs Act 1975.

Clause 1 relates to the Title and commencement.

Clause 2 transfers from Part 4 of Schedule 3 to the Act to Part 5 of that Schedule a small number of barbiturates when mixed with other pharmacologically active ingredients. This will enable the present requirements as to storage of such substances to be relaxed slightly.

The clause also adds to the list of exempted drugs in Part 6 of Schedule 3 several preparations containing very small amounts of a controlled drug in a medicine.
