Misuse of Drugs Order 1982

Pursuant to section 4 of the Misuse of Drugs Act 1975, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

Order

1 Title and commencement
  • (1) This order may be cited as the Misuse of Drugs Order 1982.

    (2) This order shall come into force on the 14th day after the date of its notification in the Gazette.

2 Schedule 3 of Act amended
  • (1) Part 2 of Schedule 3 of the Misuse of Drugs Act 1975 is hereby amended by adding the name of the following substance:

    PROPOXYPHENE (a-4- (N, N-dimethylamino)-1, 2-diphenyl-3-methyl-2 propionoxybutane), except in preparations of propoxyphene described in clause 5A of Part V of this Schedule.

    (2) Part 5 of the said Schedule 3 is hereby amended by inserting in clause 1, in their appropriate alphabetical order, the name of the following substances:

    MAZINDOL (5-(4-chlorophenyl)-2, 5-dihydro-3H-imidazo (2, 1-a)-isoindol-5-ol).

    PHENTERMINE (2-amino-2-methyl-1-phenylpropane).

    (3) Part 5 of the said Schedule 3 is hereby further amended by inserting, after clause 5 (as substituted by clause 2(2) of the Misuse of Drugs Order 1978), the following clause:

    • Preparations of propoxyphene for oral use containing not more than 135 milligrammes of propoxyphene base per dosage unit or with a concentration of not more than 2.5 percent in undivided preparations, being preparations whereof none of the other ingredients is a substance named or described in Schedules 1 or 2 of this Act or in Parts 1 to 5 of this schedule.

    (4) Part 5 of the said Schedule 3 is hereby further amended by omitting from clause 6 (as so substituted) the words or clause 5, and substituting the words clause 5, or clause 5A.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

The order adds a number of substances to Schedule 3 of the Misuse of Drugs Act 1975 (Class C controlled drugs), in accordance with recent decisions of the Commission on Narcotic Drugs of the Economic and Social Council of the United Nations.
