PURSUANT to section 55A of the Maori Trust Boards Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, being satisfied that certain irregularities occurred in the election of members of the Ngati Whatua of Orakei Maori Trust Board held in September 1982, including a failure to comply with the provisions of—

  • (a) Regulation 6 of the Maori Trust Board Regulations 1960, relating to the form of ballot papers; and

  • (b) Regulation 10 of those regulations, relating to the sending of a copy of the roll of beneficiaries to the Returning Officer; and

  • (c) Regulation 11 of those regulations, relating to the issuing of ballot papers; and

  • (d) Regulation 12 of those regulations, relating to the custody of returned ballot papers; and

  • (e) Regulation 13 of those regulations, relating to the checking and marking of the roll,—

and on being satisfied that it would not be proper or desirable to validate those irregularities under section 55 of the said Act, hereby makes the following order.

1 Title
  • This order may be cited as the Ngati Whatua of Orakei Maori Trust Board Order 1983.

2 Election declared invalid
  • The election of members of the Ngati Whatua of Orakei Maori Trust Board held in 1982 is hereby declared invalid.

3 Fresh election to be held
  • There shall be a fresh election of members of the Ngati Whatua of Orakei Maori Trust Board in accordance with the following provisions:

    • (a) Not later than the 4th day of November 1983 the Secretary of the Board shall cause public notice to be given to beneficiaries of the Board of the fact that nominations are called for election to membership of the Board for the ensuing term, the method of lodging nominations, and the latest date, as fixed by paragraph (b) of this clause, by which nominations must be lodged with the Secretary of the Board:

    • (b) Nominations shall be lodged with the Secretary of the Board not later than the 5th day of December 1983:

    • (c) Where an election is required, the Secretary of the Board shall, not later than the 19th day of December 1983, post to each beneficiary shown on the roll of beneficiaries as entitled to vote at the election a printed ballot paper setting out the full names of each candidate for election, the method of marking the ballot paper to indicate the beneficiary's preference, the address to which the ballot paper is to be returned, and the latest time for its return:

    • (d) Ballot papers shall, not later than the 27th day of January 1984, be posted to or lodged with the Returning Officer appointed for the purpose of the election by the Minister:

    • (e) The Secretary of the Board shall, not later than the 13th day of February 1984, forward to the Secretary for Maori Affairs the names of the persons elected as members of the Board:

    • (f) Subject to the preceding provisions of this clause, the provisions of the Maori Trust Boards Act 1955 shall apply to and in respect of the election.
