  • Preamble

    WHEREAS, by virtue of certain provisions of the Maori Trust Boards Act 1955,—

    • (a) An election of members of the Aupouri Maori Trust Board should have been held in 1979, but was not held until 1980; and

    • (b) The persons who were then elected to be members of that Board should have been appointed as members of that Board, but have never been so appointed; and

    • (c) A further election of members of that Board should have been held in 1983, but no such further election has ever been held:

    And whereas it is desirable to validate the election of members of that Board held in 1980, to deem the persons then elected to be members of that Board to have been appointed as members, and to make provision for a further election of members of that Board:

NOW THEREFORE, PURSUANT to section 55 of the Maori Trust Boards Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

1 Title
  • This order may be cited as the Aupouri Maori Trust Board Order 1985.

2 Election validated notwithstanding lateness
  • The election of members of the Aupouri Maori Trust Board held in 1980 is hereby declared to be and to have always been valid, notwithstanding that each of the following matters was done later than the time prescribed by the relevant provisions of the Maori Trust Boards Act 1955:

    • (a) The calling of nominations in accordance with section 46 of the Act:

    • (b) The lodging of nominations with the Secretary of the Board, in accordance with section 47 of the Act:

    • (c) The posting of ballot papers, in accordance with section 51 of the Act:

    • (d) The return of ballot papers in accordance with section 52 of the Act:

    • (e) The forwarding to the Secretary for Maori Affairs of the names of the persons elected, in accordance with section 49 of the Act.

3 Certain person deemed to have been appointed
  • The following persons, being those who were elected to be members of the Aupouri Maori Trust Board at the election referred to in clause 2 of this order, shall be deemed to have been appointed as members of that Board, in accordance with section 14(2) of the Maori Trust Boards Act 1955, immediately before the first meeting of that Board following that election:

    • William Brown of Te Hapua, Labourer

    • Temepara Wahanui Kaaka of Te Kao, Farmer

    • Allen Wiki Karena of Kohukohu, School Teacher

    • Ngatote Matiu, formerly of Te Kao, Farmer, now deceased

    • Etana Nathan, formerly of Te Kao, Farmer, now deceased

    • Rapata Norman of Te Hapua, Fisherman

    • Hopa Hone Paraone, formerly of Te Kao, Farmer, now deceased

    • Mere Petricevich of Ahipara, Retired Social Worker

    • Andrew Milton Rollo, formerly of Te Kao, Farmer, now deceased

    • Hector Subritzky of Ngataki, Farmer

    • George Witana of Te Kao, School Teacher.

4 Next election to be held
  • The next election of members of the Aupouri Maori Trust Board, which should have been held in 1983, shall be held in accordance with the following provisions:

    • (a) Not later than the 15th day of November 1985 the Secretary of the Board shall cause public notice to be given to beneficiaries of the Board of the fact that nominations are called for election to membership of the Board for the ensuing term, the method of lodging nominations, and the latest date, as fixed by paragraph (b) of this clause, by which nominations must be lodged with the Secretary of the Board:

    • (b) Nominations shall be lodged with the Secretary of the Board not later than the 15th day of December 1985:

    • (c) Where an election is required, the Secretary of the Board shall, not later than the 15th day of January 1986, post to each beneficiary shown on the roll of beneficiaries as entitled to vote at the election a printed ballot paper setting out the full names of each candidate for election, the method of marking the ballot paper to indicate the beneficiary's preference, the address to which the ballot paper is to be returned, and the latest time for its return:

    • (d) Ballot papers shall, not later than the 15th day of February 1986, be posted to or lodged with the Returning Officer appointed for the purpose of the election by the Minister:

    • (e) The Secretary of the Board shall, not later than the 28th day of February 1986, forward to the Secretary for Maori Affairs the names of the persons elected as members of the Board:

    • (f) Subject to the preceding provisions of this clause, the provisions of the Maori Trust Boards Act 1955 shall apply to and in respect of the election.
