Pursuant to section 56 of the Maori Trust Boards Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following regulations.

Regulations

1 Title and commencement
  • (1) These regulations may be cited as the Maori Trust Boards Regulations 1985.

    (2) These regulations shall come into force on 1 November 1985.

2 Interpretation
3 Number of members
  • Each board shall have the number of members set out opposite its name in Schedule 1.

4 Representation of specific sections or divisions of beneficiaries
  • In the case of each board specified in the first column of Schedule 2, each member shall be elected to represent a specific section or division of the beneficiaries; and the number of members to represent each specific section or division shall be the number set out in the second column of that schedule opposite the description of that section or division in the third column of that schedule.

5 Enrolment of beneficiaries of the Aupouri Maori Trust Board
  • (1) In this regulation a general beneficiary means a beneficiary of the Aupouri Maori Trust Board who is not residing in the Te Kao Maori Committee area or the Te Hapua Maori Committee area or the Ngataki area.

    (2) For the purposes of section 14(5) of the Act, a general beneficiary shall be deemed to belong to the Te Kao division or the Te Hapua division or the Ngataki division, as the case may require, if the beneficiary satisfies the board that he or she was born in the appropriate area or is in some other way properly affiliated to that area.

    (3) A general beneficiary who wishes to enrol, in reliance on subclause (2), in the Te Kao division or the Te Hapua division or the Ngataki division shall apply in the form set out in Schedule 3, and shall send the application to the secretary of the board at the address and by the date specified in the notice to beneficiaries given under section 46 of the Act.

    (4) The board shall consider every such application for enrolment, and shall determine whether or not the applicant was born in the appropriate area or is in some other way properly affiliated to that area so as to be considered to belong to it.

    (5) The secretary shall give to the applicant written notice of the board's decision.

    (6) If the board declines the application, the applicant shall be enrolled in the General division, if he or she is qualified to be so enrolled.

6 Public notice of calling of nominations
  • The public notice required by section 46 of the Act to be given to beneficiaries of the fact that nominations are called for election to membership of the board shall be in the form set out in Schedule 4.

7 Nomination papers
  • (1) Where there are no specific sections or divisions of beneficiaries, nomination papers shall be in the form set out in Schedule 5.

    (2) Where there are specific sections or divisions of beneficiaries, nomination papers shall be in the form set out in Schedule 6.

8 Copy of roll to be sent to Returning Officer
  • (1) The secretary of each board shall, not later than 3 clear days before the last day fixed under section 52 of the Act for the receipt of ballot papers by the Returning Officer in any case where an election is required under section 48 of the Act, forward to the Returning Officer the document or the various documents constituting the roll of the board's beneficiaries, showing clearly, in any case where a parliamentary roll of electors is used, the manner in which the board's beneficiaries are identified on that roll.

    (2) At the same time, the secretary of the board shall also forward to the Returning Officer—

    • (a) a copy of the resolution of the board approving the roll for the purposes of the election; and

    • (b) the total number of ballot papers printed, issued, and not issued; and

    • (c) the total number of beneficiaries on the roll; and

    • (d) if there are specific sections or divisions of the beneficiaries, the total number in each section or division.

    (3) If there are no specific sections or divisions of beneficiaries, the beneficiaries shall be numbered consecutively on the roll.

    (4) If there are specific sections or divisions of the beneficiaries, those in each section or division shall be given a consecutive number preceded by the section or division number and a hyphen.

9 Ballot papers
  • (1) Where there are no specific sections or divisions of beneficiaries, the ballot papers shall be in the form set out in Schedule 7.

    (2) Where there are specific sections or divisions of beneficiaries, the ballot papers shall be in the form set out in Schedule 8, and the ballot papers for each division shall be printed on different coloured paper.

    (3) The ballot paper issued to each beneficiary shall have entered on it the beneficiary's roll number and shall be posted to the beneficiary, together with a business reply envelope addressed to the Returning Officer and having on its outside on the left-hand top corner the beneficiary's roll number.

10 Voter to make declaration
  • Every beneficiary who casts a vote shall at the same time sign a declaration in the form set out in Schedule 9.

11 Death of candidate
  • (1) Except as provided in subclause (2), if a candidate who has been nominated for election dies during the period commencing with the closing date for nominations and ending with the date fixed for the election, the election shall be postponed; and, in such a case, a new closing date for nominations and a new election shall be appointed by Order in Council under section 55 of the Act.

    (2) Where the deceased candidate was nominated for election to represent a specific section or division of beneficiaries, that candidate's death shall not affect the election of candidates nominated to represent any other section or division of beneficiaries.

12 Custody of returned ballot papers
  • All envelopes containing ballot papers received by the Returning Officer up to the closing date of the poll shall be placed and kept by the Returning Officer in a locked ballot box until the counting of the votes.

13 Checking and marking roll
  • (1) Before any envelope containing a ballot paper is opened, the Returning Officer shall rule with a ballot pencil a line through the entry on the roll corresponding with the number on the envelope.

    (2) If, on any such check, it appears that a beneficiary may have voted more than once, the envelopes containing the apparent plural votes shall be put aside for investigation after the other votes have been counted.

    (3) When the checking has been completed, the marked roll shall be signed by the Returning Officer and the checking officer, and by any scrutineers present, and then placed in an envelope which shall be sealed.

14 Counting of votes
  • (1) After the roll has been placed in an envelope and the envelope sealed, the envelopes containing the ballot papers shall be opened in the presence of any scrutineers who have been appointed and are present, and of a checking officer appointed by the Returning Officer.

    (2) The checking officer shall be either a Justice of the Peace or some other person approved for the purpose by the Secretary for Maori Affairs.

    (3) The result of the voting shall, after the votes have been counted, be recorded in triplicate in the form set out in Schedule 10.

    (4) Two copies of the results statement duly signed shall be forwarded to the secretary of the board, who shall thereupon transmit 1 copy to the Secretary for Maori Affairs.

    (5) If any envelopes containing apparent plural votes are insufficient in number to affect the new membership of the board or of any specific section or division, as the case may require, the result of the election may be declared without first checking the validity of the disputed votes; but, if the result could be affected, the result shall not be declared until the disputed votes have been either allowed or disallowed after investigation by the Returning Officer.

    (6) In any case where 2 or more persons receive an equal number of votes and 1 or more (but not all) of them would have received sufficient votes to be elected had 1 or more of the persons receiving the same number of votes received 1 vote less, the Returning Officer shall exercise a casting vote to determine which 1 or more of the persons in question shall be deemed to have been elected.

15 Retention of voting records
  • All ballot papers and other voting records shall be kept by the Returning Officer for at least 3 months after the declaration of the result of the election.

16 Expenses and remuneration of Returning Officer
  • Each board shall, within 6 weeks of demand being made, pay to the Returning Officer all expenses properly incurred by the Returning Officer in connection with the election, and such sum by way of remuneration for the Returning Officer's services as may be fixed by the Minister.

17 Transitional provision in respect of Aupouri Maori Trust Board
  • Notwithstanding the change in representation on the Aupouri Maori Trust Board effected by regulation 4, the members of that board in office immediately before the commencement of these regulations shall continue in office, and shall continue to represent the specific sections or divisions of the beneficiaries that they were elected to represent, until the persons elected as members at the next election of members of the board, or such of those persons as are qualified to be appointed, come into office.

18 Revocations
  • The regulations specified in Schedule 11 are hereby revoked.
