  • Preamble

    WHEREAS, pursuant to the Aupouri Maori Trust Board Order 19851, an election of members of the Aupouri Maori Trust Board is to be held:

    And whereas nominations for that election closed on the 15th day of December 1985:

    And whereas Temepara Wahanui Kaaka of Te Kao, farmer, was duly nominated for the Te Kao division of the beneficiaries:

    And whereas on the closing of nominations on the said 15th day of December 1985 the number of persons nominated for that division of beneficiaries exceeded 4 (being the number of appointments to be made in respect of that division) so that an election is necessary:

    And whereas the date fixed for the return of ballot papers for the purposes of that election was the 15th day of February 1986:

    And whereas the said Temepara Wahanui Kaaka died on the 20th day of January 1986 (being a date between the date fixed for the closing of nominations and the date fixed for the election):

    And whereas, by virtue of regulation 11 of the Maori Trust Boards Regulations 19852, the effect of Mr Kaaka's death is to postpone the election of members for the Te Kao division of beneficiaries and to necessitate the appointment by Order in Council pursuant to section 55 of the Maori Trust Boards Act 1955 of a new closing date for nominations and a new election for that division:

NOW, THEREFORE, PURSUANT to section 55 of the Maori Trust Boards Act 1955 and regulation 11 of the Maori Trust Boards Regulations 19853, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

1 Title
  • This order may be cited as the Aupouri Maori Trust Board Order 1986.

2 New election for Te Kao division of beneficiaries
  • The next election of members for the Te Kao division of the beneficiaries of the Aupouri Maori Trust Board, which was to have been held by the 15th day of February 1986, shall be held in accordance with the following provisions:

    • (a) Not later than the 7th day of March 1986 the Secretary of the Board shall cause public notice to be given to every beneficiary of the Board who is enrolled in the Te Kao division of the fact that nominations are called for election to membership of the Board for the ensuing term, the method of lodging nominations, and the latest date, as fixed by paragraph (b) of this clause, by which nominations must be lodged with the Secretary of the Board:

    • (b) Nominations shall be lodged with the Secretary of the Board not later than the 7th day of April 1986:

    • (c) Where an election is required, the Secretary of the Board shall, not later than the 7th day of May 1986, post to each beneficiary shown on the roll of beneficiaries as entitled to vote at the election a printed ballot paper setting out the full names of each candidate for election, the method of marking the ballot paper to indicate the beneficiary's preference, the address to which the ballot paper is to be returned, and the latest time for its return:

    • (d) Ballot papers shall, not later than the 7th day of June 1986, be posted to or lodged with the Returning Officer appointed for the purpose of the election by the Minister:

    • (e) The Secretary of the Board shall, not later than the 21st day of June 1986, forward to the Secretary for Maori Affairs the names of the persons elected as members of the Board for the Te Kao division of the beneficiaries:

    • (f) Subject to the preceding provisions of this clause, the provisions of the Maori Trust Boards Act 1955 shall apply to and in respect of the election.
