  • Preamble

    WHEREAS an election of members of the Taranaki Maori Trust Board is due: And whereas, by virtue of regulation 4 of the Maori Trust Boards Regulations 19851, members of that Board are to be elected to represent the specific sections or divisions of beneficiaries specified in Schedule 2 to those regulations: And whereas nominations for the election now due closed on the 1st day of August 1987: And whereas no valid nominations were received before that date in respect of the section or division comprising beneficiaries of the Ngati Taranaki tribe nor in respect of the section or division comprising beneficiaries of the Ngarauru tribe: And whereas no sufficient provision is made by or under Part 3 of the Maori Trust Boards Act 1955 for the case that has arisen in respect of those 2 sections or divisions and it is desirable to make provision accordingly: And whereas Charles Tareterutu Bailey, of Waitara, Farmer was duly nominated for the section or division comprising beneficiaries of the Atiawa tribe: And whereas on the closing of nominations on the said 1st day of August 1987 the number of persons nominated for that section or division of beneficiaries exceeded 1 (being the number of appointments to be made in respect of that section or division) so that an election was necessary: And whereas the date fixed for the return of ballot papers for the purposes of that election was the 1st day of October 1987: And whereas the said Charles Tareterutu Bailey died on the 24th day of September 1987 (being a date between the date fixed for the closing of nominations and the date fixed for the election): And whereas, by virtue of regulation 11 of the Maori Trust Boards Regulations 1985, the effect of Mr Bailey's death is to postpone the election of members for that section or division of beneficiaries and to necessitate the appointment of a new closing date for nominations and a new election for that section or division:

NOW THEREFORE, PURSUANT to section 55 of the Maori Trust Boards Act 1955 and to regulation 11 of the Maori Trust Boards Regulations 1985, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

1 Title
  • This order may be cited as the Taranaki Maori Trust Board Order 1987.

2 Interpretation
  • In this order the term affected division of beneficiaries means—

    • (a) The section or division comprising beneficiaries of the Atiawa tribe; and

    • (b) The section or division comprising beneficiaries of the Ngati Taranaki tribe; and

    • (c) The section or division comprising beneficiaries of the Ngarauru tribe.

3 New election for affected divisions of beneficiaries
  • The next election of members for each of the affected divisions of beneficiaries of the Taranaki Maori Trust Board, which was to have been held by the 1st day of October 1987, shall be held in accordance with the following provisions:

    • (a) Not later than the 1st day of February 1988 the Secretary of the Board shall cause public notice to be given to every beneficiary of the Board who is enrolled in each of the affected divisions of beneficiaries of the fact that nominations are called for election to membership of the Board for the ensuing term, the method of lodging nominations, and the latest date, as fixed by paragraph (b) of this clause, by which nominations must be lodged with the Secretary of the Board:

    • (b) Nominations shall be lodged with the Secretary of the Board not later than the 1st day of March 1988:

    • (c) Where an election is required, the Secretary of the Board shall, not later than the 1st day of April 1988, post to each beneficiary shown on the roll of beneficiaries as entitled to vote at the election a printed ballot paper setting out the full names of each candidate for election, the method of marking the ballot paper to indicate the beneficiary's preference, the address to which the ballot paper is to be returned, and the latest time, as fixed by paragraph (d) of this clause, for its return:

    • (d) Ballot papers shall, not later than the 1st day of May 1988, be posted to or lodged with the Returning Officer appointed for the purpose of the election by the Minister:

    • (e) The Secretary of the Board shall, not later than the 11th day of May 1988, forward to the Secretary for Maori Affairs the names of the persons elected as members of the Board for each of the affected divisions of beneficiaries:

    • (f) Subject to the preceding provisions of this clause, the provisions of the Maori Trust Boards Act 1955 shall apply to and in respect of the election.
