  • Preamble

    WHEREAS an election of members of the Taitokerau Maori Trust Board has been held recently, the date fixed for the return of ballot papers for the purposes of that election being the 1st day of October 1987: And whereas, by virtue of regulation 4 of the Maori Trust Boards Regulations 19851, members of that Board are to be elected to represent the specific divisions of beneficiaries specified in Schedule 2 to those regulations: And whereas nominations for the election closed on the 1st day of August 1987: And whereas the number of persons nominated by that date for the Ngapuhi ki Whangaroa division of beneficiaries exceeded 1 (being the number of appointments to be made in respect of that division) so that an election was necessary: And whereas one of those so nominated for that division was Nickolas Smith of Whangarei, Telecom Supervisor: And whereas Mr Smith's name was omitted from the ballot papers in the mistaken belief that his nomination was not valid: And whereas it would not be proper or desirable to validate that irregularity under section 55 of the Maori Trust Boards Act 1955:

NOW THEREFORE, PURSUANT to section 55A of that Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

1 Title
  • This order may be cited as the Taitokerau Maori Trust Board Order 1987.

2 Election declared invalid
  • The election of a member of the Taitokerau Maori Trust Board to represent the Ngapuhi ki Whangaroa division of beneficiaries of that Board, for which ballot papers were required to be returned by the 1st day of October 1987, is hereby declared to be invalid.

3 Fresh election
  • A fresh election for a member of the Taitokerau Maori Trust Board to represent the Ngapuhi ki Whangaroa division of beneficiaries of that Board shall be held in accordance with the following provisions:

    • (a) Not later than the 1st day of February 1988 the Secretary of the Board shall cause public notice to be given to every beneficiary of the Board who is enrolled in the Ngapuhi ki Whangaroa division of beneficiaries of the fact that nominations are called for election to membership of the Board for the ensuing term, the method of lodging nominations, and the latest date, as fixed by paragraph (b) of this clause, by which nominations must be lodged with the Secretary of the Board:

    • (b) Nominations shall be lodged with the Secretary of the Board not later than the 1st day of March 1988:

    • (c) If an election is required, the Secretary of the Board shall, not later than the 1st day of April 1988, post to each beneficiary shown on the roll of beneficiaries as entitled to vote at the election a printed ballot paper setting out the full names of each candidate for election, the method of marking the ballot paper to indicate the beneficiary's preference, the address to which the ballot paper is to be returned, and the latest time, as fixed by paragraph (d) of this clause, for its return:

    • (d) Ballot papers shall, not later than the 1st day of May 1988, be posted to or lodged with the Returning Officer appointed for the purpose of the election by the Minister:

    • (e) The Secretary of the Board shall, not later than the 11th day of May 1988, forward to the Secretary for Maori Affairs the name of the person elected as a member of the Board for the Ngapuhi ki Whangaroa division of beneficiaries:

    • (f) Subject to the preceding provisions of this clause, the provisions of the Maori Trust Boards Act 1955 shall apply to and in respect of the election.
