PURSUANT to section 234(1) of the Coal Mines Act 1979, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

1 Title and commencement
  • (1) This order may be cited as the Coal Mines (Coal Mining Industries Welfare Fund Levy) Order 1988.

    (2) This order shall come into force on the 1st day of October 1988 and shall apply to the sum due under section 234(1) of the Coal Mines Act 1979 on all marketable coal in respect of the period of 3 months ending on the last day of September 1988 and subsequent periods of 3 months.

2 Coal Mining Industries Welfare Fund Levy
  • It is hereby declared that the levy payable under section 234(1) of the Coal Mines Act 1979 shall be—

    • (a) A sum equivalent to 8 cents per tonne or part of a tonne on all marketable coal (other than peat mined for horticultural purposes) raised from the coal mine as a contribution towards Welfare Fund services; and

    • (b) Where a coal mine is situated within an area for the time being defined under section 236(5) of the Coal Mines Act 1979 in respect of a rescue station, a sum equivalent to 40 cents per tonne or part of a tonne on all marketable coal (other than peat mined for horticultural purposes) raised from the coal mine as a contribution towards rescue station services.

3 Revocation
  • The Coal Mines (Coal Mining Industries Welfare Fund Levy) Order 19861 is hereby revoked.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order amends the rates of levy payable in respect of the Coal Mining Industries Welfare Fund from 50 cents to 40 cents per tonne or part of a tonne on all marketable coal (other than horticultural peat) raised from a coal mine situated within a rescue station area, as a contribution to rescue station services.

These rates apply to the sum payable in respect of the period of 3 months ending on 30 September 1988 and subsequent periods of 3 months.
